Answered 4 years and 7 months ago by attorney Ms. Dorothea Elaine Laster   |   1 Answer   |  Legal Topics: Child Abuse And Neglect
It is legal for CPS to talk with children without the parent being present and without parental permission.  People do not have to let people into their homes without a Court order.

If you believe that some sort of criminal conduct has occurred where your child is the victim, you should contact the police department immediately and show them the messages from your daughter. This may lead to whoever is responsible for hitting the child being arrested, and will almost certainly lead to an ACS investigation. Additionally you can speak with an attorney regarding filing a custody suit. ... Read More

You may be able to get an order granting you a possession schedule for your grandchildren. You would have to show that denial of possession of or access to the child would significantly impair the child's physical health or emotional well-being. This is often proven by showing that you had a previous relationship with the children. Thus, denying them the relationship would significantly impair the children's physical health or emotional well-being. Did the children ever live with you? Did you see them regularly before your child died? These and many other questions would need to be explored. Also, the mom might agree to a schedule once you file suit. ... Read More

Obviously, the child can live in any safe place. However, if her biological parents are not willing to agree for her to live somewhere else, a court case would have to be opened for someone to get conservatorship of the child. If one of the parents will agree that the child can live with a relative, there is a form that a parent could sign to give the other relatives the right to care for the child, enroll the child in school, etc.... can a 16 and 20 year old date in Florida?

Answered 7 years and 7 months ago by Heather Cherepkai (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Abuse And Neglect
It is not the act of dating itself that is illegal, but the contact between the 16 year old and 20 year old that is not permissible and thus in a nutshell, the 20 year old should not engage in any relationship with a 16 year old.

If I were to fight a child neglect charge would that prolong me getting my girls back?

Unfortunately, these cases are based on more than just being a good parent.  You should have either been appointed an attorney for the DCF case or should seek to have representation as this is serious and could impact your parental rights in the future as well.  Typically, you can go to trial and dispute the allegations and still engage in services to get your children back.  You can ask for referrals for those things that DCF wants you to do to get your children back.  It will help you in the long run, because if you do not win at trial then you will be starting at the beginning and that will prolong the reunfication with the children. An attorney is very helpful and necesary in these cases.  ... Read More
