Do I still pay her mom child support?

Answered 10 years and 2 months ago by attorney Vanessa J. Gorden   |   5 Answers   |  Legal Topics: Child Custody
Yes, unless she is no longer dependent upon the mother for support (she is residing on her own), in which case you could petition the court to pay your support directly to your daughter until she turns 19. For more specifics, consult with a local family law attorney. Best wishes!

How often can the court be petitioned to modify child support?

Answered 10 years and 2 months ago by attorney Vanessa J. Gorden   |   7 Answers   |  Legal Topics: Child Custody
There is no magic time frame. The standard to modify is whether a "material and substantial change in circumstances not in the contemplation of the parties at the time of the last order" has occurred. Generally, the change must result in an upward or downward change in amount owed by at least 10%. For the other criteria, you should speak with a family law attorney. Best wishes!... Read More

How often can the court be petitioned to modify child support?

Answered 10 years and 2 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Child Custody
The only real limit is the patients of the court. Usually you will need to show a change in circumstances great enough to warrant a change. If you cannot show such a change, or that some statutory period of time has passed, don't waste the courts time or your money.

What do I have to do to make my husband my daughter's legally adoptive father?

Answered 10 years and 6 months ago by John F. Brennan (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
I would need more details, if the biological father is amenable to this should not be a particularly difficult situation and your husband should be able to adopt the daughter he has raised. If the biological father objects it will be much more complex and expensive.

How can I reverse legal guardianship?

Answered 10 years and 6 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
Hire a lawyer. It's almost always worth the investment. Your lawyer will likely advise you to file a petition to terminate the guardianship. Of course you will need some legally cognisable grounds for terminating the guardianship, but they may already exist. Good Luck.

Could I collect child support if I am living with the father?

Answered 10 years and 6 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
Your dating or not with the other parent, is not relevant. But sharing lodgings is usually a basis for denying or deferring child support. If you really like the guy and you are living with him, and if he is contributing to the household expenses, why bother about support?

If she cannot pick them up on Wednesday, do I have to give her another day?

Answered 10 years and 6 months ago by Diane L. Berger (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
I think it depends on why she can't see them in Wednesday. If she has to work or has something like that. I would suggest you give her a different day. If she just wants to go out with her boyfriend that would not require your flexibility.

If a verbal agreement was made, can my ex ask for child support?

Answered 10 years and 7 months ago by Tina Marie Fox (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Child Custody
Yes, she can. ย Circumstances may have changed and she is entitled, in IL, to have financial assistance from you, as the father. In IL, you have a legal responsibility to care for the child, at minimum, financially.

If a verbal agreement was made, can my ex ask for child support?

Answered 10 years and 7 months ago by John F. Brennan (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Child Custody
Yes, she can take you back to court and enforce a child support obligation as, under the law, child support is due for the benefit of the child and not a matter of an agreement between the parents. I would see an attorney with details.

If a verbal agreement was made, can my ex ask for child support?

Court always retains jurisdiction over the issue of child support. Parents cannot contract away that jurisdiction, either orally or in writing.

If a verbal agreement was made, can my ex ask for child support?

Answered 10 years and 7 months ago by attorney Vanessa J. Gorden   |   7 Answers   |  Legal Topics: Child Custody
A verbal agreement to not take child support would likely be void under public policy. If your child/children are over the age of majority, then she likely cannot come back for back support. You will need to be certain that, if support was ordered through the court, the correct documentation to stop it was filed. If the two of you agreed informally without a modification order, then the amount will have continued to accrue and you would be looking at past due amounts. You should visit with an attorney about the specifics of your situation right away.... Read More

At least in Nebraska a custodial parent doesn't have the right to give up child support that really belongs to the child.

If a verbal agreement was made, can my ex ask for child support?

Answered 10 years and 7 months ago by Atty. Tajara Dommershausen (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Child Custody
Child support is for the benefit of the child not the mother. Child support can be changed any time there is a substantial change of circumstance.

Could a father be granted custody or visitation if he has physically abused the mother?

Answered 10 years and 7 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
Well, his abusive actions certainly will argue against his having unsupervised contact with the child, but his having at least some placement is not totally impossible. You will need an experienced family law attorney. It's almost always worth the investment. Good Luck.

How can I keep my ex from getting any sort of child custody?

Answered 10 years and 7 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
First things first: you should retain a capable divorce lawyer in your area to advise and represent you. Your lawyer will likely suggest that s/he file a motion for a protective order (under this or some name) to keep him away from you and your children The report you mention should be very helpful. Being indicted for a crime has little legal weight outside of the criminal case: it is merely a formal accusation, and far from proof beyond a reasonable doubt. You would do well to take all the usual precautions about your family's personal security: doors locked with strong locks; window locks; notification to the local police of the threats against you.... How do I begin the process of terminating parental child support rights and where to begin?

Answered 10 years and 7 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
Just cause to a sane reasonable person, and just cause to a court can look very different. Since there is a constitutional right involved, courts have rather strict criteria you must meet to do an Involuntary Termination of Parental Rights. How could I change child custody?

You will have to explain to the judge why you want a change is residential custody to allow the children to live with you. You also have to have some proof of the allegations you are alleging. Is it difficult? Depends on the allegations and the proof you have. Difficulty is a case-by-case basis. Speak with an attorney to determine your level of difficulty.... Read More

How can out of state grandparents get custody of their grandchildren?

Answered 10 years and 8 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
In Wisconsin it is not entirely impossible, but it is very very hard. You would have to show that both parents are truly harmful to the child(ren). This would be an expensive proposition, probably requiring hiring a lawyer (which is a good idea in any court matter) and very likely an private investigator. Consult an experienced matrimonial lawyer in your area for advice and representation or at least to get some idea of how it is done in your neck of the woods and what it might involve in terms of costs....
