I have to assume that she is violating a court order presently in effect. Generally what will happen in such a case is she will lose custody to you. You'll need an attorney to counsel you and prosecute case after all of the details are understood.

What does the court order say? In Idaho, the obligation to provide for support for the child generally ends on the later of the child turning 18, graduating high school or turning 19. In this case, dad doesn't have to do anything more.

How do I apply for joint custody of my minor daughter while I am in prison?

Answered 12 years ago by Helene Ellenbogen (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Child Custody
You can establish paternity and set the stage for a parenting plan and child support when you get out. However, first, there is no custody as such in WA. Second, no reasonable judge would provide for joint decision making while you're in prison. Third, no reasonable judge would provide for a 50/50 schedule when you get out as the child will have had no history with you. Depending on the crime for which you are doing time, you will likely start with supervised visitation when you get out.... Read More

What can I do if I want to live with a different parent?

Answered 12 years ago by Helene Ellenbogen (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
If you run away it isn't kidnapping, it's running away. If there is something abusive going on in your mother's home, then you can report that to the juvenile authorities. But if it's just a matter of wanting to live with your Dad, you should discuss this with both your parents and if possible a therapist or counselor to help your parents figure out what is best for you.... Do I need to get permission from my ex to take my kids out of state for trips and vacations?

Answered 12 years ago by Helene Ellenbogen (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Child Custody
If you have a well written parenting plan, it outlines what you're supposed to do. It is always preferable to give notice of where the children will be and how they can be reached (phone and address) as well as exact dates of course. You can do a minor modification of the parenting plan to add this requirement and any other reasonable items that were left out. Have a lawyer review the plan for those kinds of issues, preferably not the lawyer who drew up or agreed to the plan without these items being included.... Read More

Is there a way I can get temporary custody of my grand daughter without an attorney and if so, what do I need to do?

Answered 12 years ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
The parents could give you a power of attorney. If just one does, the other parent can still claim custody. So, barring that, no, there is no way for you to get custody without an attorney.

If you don't have a parenting plan get one immediately. You don't say what your legal relationship is to the child or the mother. Once you have filed with the court (divorce, parentage action, parenting plan ) you can make a motion to allow you to take the child to therapy. More importantly, you can ask for a Guardian ad Litem who will investigate both homes and make recommendations for a parenting plan.... Read More

Will the father of my son still have to pay child support if he signs away his rights?

Answered 12 years ago by Helene Ellenbogen (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
You can't terminate someone's rights if they haven't been established first or if there is no one else to assume them. If you're not married to this man, you don't have to put him on the birth certificate and as long as you don't rely on the state for public benefits, no one but you can go after him for child support.... You have to take it to court as private agreements about children are not legal, let alone enforceable. Both of you have equal rights to the children if they are both of your children.
