You'll probably need an expert to testify that can't tell when you smoked from metabolites. If possible do urine test. It only shows non-psychoactive metabolite that stays in body for 45 days.

If you have a prescription, take it along for the test, show it to them and provide it to DCFS. If you are legally using, then there is no issue.

Can legal use of marijuana cause you to lose your kids and what are my rights?

Answered 11 years and 11 months ago by Andrea Rogers (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Child Custody
Marijuana use is not legal in Missouri. If you are in a state where marijuana is legal but you are prohibited from using marijuana because of charges of child abuse (I assume this because you mention DCFS), then you won't be able to successfully dispute the dirty drug test.

You have a chance to be awarded custody. But your situation is such that you should seriously consider hiring an attorney to handle it. You have a lot going on and there are too many potential twists and turns to give a better answer than that.

Yes, it is possible that you could be awarded custody. Michigan courts decide custody based on the child's best interests. One of the factors considers each person's mental and physical health. But that is only one of 12 factors.

Can a biological father file for custody after adoption since he was not informed of the adoption?

Answered 11 years and 11 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
I kind of doubt it. You might be able to make a claim because you weren't notified and you were easy to find. However, if you did get notice and either didn't object or did object and your objection did not win, then no, you won't be able to get your rights back.

Can CPS take my kid if have a closed CPS case?

New kid or old one. New one, probably not unless there is another complaint. Of course if the hospital knows of drug use while pregnant, that might go it. For the old kid, maybe if you haven't complied with their requirements, but again, I would think that a complaint would be necessary first.... Read More

Can an illegal immigrant get joint custody over a US citizen even though the immigrant has never been alone with the kids?

Answered 11 years and 11 months ago by Helene Ellenbogen (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
If he's in the US he gets to have time with the child. Custody is not at issue in WA. How much residential time he will get depends on a long list of factors. His status is not one of them.

If you gave birth to the baby in the US, the baby is a US citizen and does not need a visa for the US. You can probably also register him with the Indian Embassy to see if he derives any Indian citizenship rights by virtue of his parents' nationality/citizenship.

Can a father's parental rights be terminated without his knowledge or consent?

Answered 11 years and 11 months ago by Aimee Carol Robbins (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Child Custody
His rights should not have been terminated. I think in this type of case, an attorney may be necessary to regain what was stolen from him.

Can the father file for custody of our child and not allow me and my child to leave town in the future?

Answered 11 years and 11 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
He is the father and has as much right to custody as you do. He can't prevent you from moving from the town, but the court can. More than likely the court will order you to live close enough so that visitation will not be a problem. You will be allowed to move out of state, but the child will have to stay with the father, all things being equal.... Read More

Answered 11 years and 11 months ago by Tina Marie Fox (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Child Custody
If there is any doubt, then no, you shouldn't sign the birth certificate. However, the certificate is not generated the same day, so if you inform the hospital on the day of birth, you may be able to receive the results back before the certificate is made available.

Answered 11 years and 11 months ago by Ernest A Cardona (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Child Custody
If the clerk of the court deems the file still open, and DCSS used it to file for child support, that does not void their orders. You should just proceed to defend yourself in the DCSS action and take appropriate steps to complete your custody case.
