When it comes to parks, being present in any manner (front seat, back seat, hood, blanket, camp chairs, standing, etc.) may be cited as an offense if the park is considered closed. Some parks, excluding permitted campers, close at sunset, some at X and most all by 11 pm on the late side. Depending on your age, it's possible the officer was being paternal and trying to shame one or both of you into not only leaving the area, but not setting up movie time in another. But unless you were actually in the park after its posted closing hours, it does not sound like you were doing anything illegal. Had you been, an actual citation or perhaps a written warning would have likely issued.... Read More

What does a case closure mean?

Answered 11 years and 10 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
Depends on the context in which the phrase is used. As one example, if a probation officer is recommending case closure, it could be because the person on probation has now completed all requirements placed on him or her in the conditions of probation.

Ask your local OK lawyer. It is possible. My experience is that the court make people get a private attorney or sign up with the PD, so the court systems run smoothly and things like this don't happen, because the police and witnesses will once be in court and you will not be ready. If you get an attorney now, he can usually get  a continuance if he asks due to a scheduling conflict. ... Read More

Can I still be arrested 5 days after the police have raided my home and did not arrest me?

Answered 12 years and 4 months ago by John J. Carney (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Criminal Defense
You should not have talked to the police. You should have retained a good criminal lawyer immediately and let him handle the matter. You can still be arrested if they found drugs. They do not have to show you a warrant. Do not try to negotiate a deal with the police without a lawyer.

Does it make it harder on a person that has warrants and has been running for a couple years the longer she waits?

Answered 12 years and 4 months ago by Kevin Hunter Pate (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
Yes, it can. When someone has warrants, generally the best result comes from securing counsel to assist with presenting one's self to the court rather than showing up. It is also advisable to have a bond person lined up and ready to go. You do not indicate where in OK you have warrants, but you are welcome to contact me for further information even if you are outside central OK.... Read More
