Do I have to disclose an expungement on a disclosure for a federal background check and why?

Answered 10 years and 6 months ago by William L. Sanders (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Criminal Defense
As far as I know, there is no legal answer to your question. I know of no law that governs this. It is usually governed by company policy. The question is: have you been arrested for, charged with, or convicted of any offense?" Well, you said: I was arrested. Obviously, when asked, you must say yes, if you wish to be truthful. Many employers will excuse arrest, and even convictions of certain crimes. But most employers will not tolerate not telling the truth. If the employer finds out, and they likely will, you likely will be discharged. I have seen valuable employees of 20+ years discharged for minor crimes that were not disclosed on the employment application. While many employees will overlook minor events, they will not overlook dishonest answers on the employment application. I always say: When in doubt, disclose. But, that is friendly advice, and not a legal answer that you may rely upon.... Read More

Will my record be cleared if I appear for my bench warrant? How?

Answered 10 years and 7 months ago by Jeff Fengcheng Yeh (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Criminal Defense
You should hire a lawyer to go to court to recall the warrant. A lawyer can do this without you present if the underlying charge is a misdemeanor, so it is less risky for you.

Hire the best and most experienced criminal defense attorney you can afford. A drug charge could ruin your daughter's future. Can they change charges after he was bailed out?

Answered 10 years and 7 months ago by Thomas Edward Gates (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
The prosecutor may change his charge at any time. His initial charge was "suspicion of possession." After the drug test, the charge can be possession if the test was positive. It had nothing to do with his refusal to work for them.

They will be tried as adults. The attorney can likely get the charge dropped to 2nd Degree, but because a weapon was used it is unlikely to be reduced further. The individual's record will determine how much jail time he will get.
