Can an illegal immigrant divorce a U.S. citizen without spousal maintenance?

Any spouse can divorce the other. Spousal maintenance is a question of one party's need and the other's ability to pay. If the person who was deported is being asked to pay maintenance, that is not going to happen as there is no way to enforce it.

How can I get alimony if my ex refuses to divorce me?

Answered 10 years and 9 months ago by Eduardo Julio Mejias (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Divorce
In Florida, you do not need the other spouse's consent for a divorce. You also do not need "grounds" to obtain the divorce. Florida has been a "no fault" divorce state for several decades. The question is not whether you will become divorced, but if alimony will be awarded, and if so, how much. His disability, if genuine, will limit how much alimony you can receive, however. Furthermore, you did not state why you do not work. A family law judge may impute (assign) an income to you, if it is shown that you have the physical and mental capability of working.... Read More

Can I make my ex pay the back taxes? How?

Answered 10 years and 10 months ago by Ronald Karl Nims (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Divorce
First, read the divorce decree. What is he required to do other than transfer the property? Is he required to pay all liens? If he's not required to pay all liens, then you need to consider suing your attorney because any competent attorney will do a title search on property before having you agree to the deal or at least specify in the agreement that the property must be transferred with a clean title. If you did the divorce without an attorney, consider it the cost of learning the lesson of the aphorism - a woman who represents herself has a fool for a lawyer.... Read More

Are parents automatically notified of marriage?

Answered 10 years and 10 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   6 Answers   |  Legal Topics: Divorce
While the fact of a marriage is not confidential, someone would have to search public records to find out if one was solemnised. But it sounds like you want to keep it secret in order to perpetrate a fraud on the in-laws, or on their insurance company. That is a VERY BAD idea. Don't do it. Good Luck.... Read More

Can my wife legally be awarded my truck?

Answered 10 years and 10 months ago by Helene Ellenbogen (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
I think you should get a lawyer since you signed off on something without knowing what you were doing. I don't know if the truck was listed in the petition, if it was, it will be harder to reopen but probably possible given that you signed off on something you clearly didn't read or understand. While ignorance is not an excuse before the law, a lawyer may be able to persuade a court that the unfairness of it trumps that dictum.... Read More

The only part of the house in which she has an interest is the equity based on his payments during the marriage. The rest of the equity is his separate property and yours 50/50. You may need a CPA to figure out exactly what each of these shares is worth. His children have nothing to do with any of it.... Read More
