How can I divorce my foreign national wife with green card?

Answered 12 years and 3 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Divorce
In most states, the citizenship of the parties in a divorce action is irrelevant. The key thing is that at least the person starting the divorce (the Petitioner) be a resident of the state for the period prescribed by state law, which varies. In Wisconsin, the party must be a resident of the state for at least six months, and of the county where he starts the action for at least 30 days. This does not sound like a marriage made in heaven. Good Luck.... Read More

Pre-nuptials are legal in Michigan in certain instances.. there must be full disclosure and no fraud..an "at home" pre-nuptial would be easier to challenge in court because it is more likely it is not done right.

If my brother doesn't give divorce, what will happen?

Answered 12 years and 4 months ago by Helene Ellenbogen (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Divorce
I don't know what a "court marriage" is. Nor do I understand how the two of them together can have a "guardian." Nor is it clear if the wife who is having an affair is the same woman you're talking about. If your brother is legally married, either one can seek a divorce, whether the other spouse wants it or not. If he was married to someone else at the time he married this "girl", then the marriage was never valid and a decree of invalidity can be entered. In either case, the marriage will end.... Read More

Is my wife entitled to any of my disability income that I use to support myself for my living needs?

Answered 12 years and 4 months ago by Helene Ellenbogen (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
Your question only makes sense if you are planning on getting divorced. If you are, you are each entitled to a portion of each other's retirment. If your disability comes out of your retirement (is construed as an early retirement, then that has to be examined. If the retirement is separate from disability, then she may or may not be entitled depending on the nature of the plan. If you have children, they are entitled to get support through SSI and any riders that may be attached to your disability pension.... Read More

If you cannot afford and attorney, check with legal aid organizations in your area.  Start with Northwest Justice Project.  You really need some legal advice and representation.  If you cannot get an attorney from legal aid, at least go to the courthouse in the county you are in and ask for a "family law facilitator" who will help you fill out documents.  Good luck.... If you have been a lawful permanent resident for more than five years, then the divorce in and of itself will not disqualify you. Do we still have to stay in our house together even if I already filed a divorce?

Answered 12 years and 5 months ago by Ms. Jessica M Cotter (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Divorce
I am not certain I understand your question. In Arizona if you were to move out of the house pending the dissolution that would not be seen by the court as you "abandoning" the house. One of you could ask the court for exclusive use of the house, but remember that if you are awarded exclusive use you would probably ordered to maintain the mortgage payments. It is important that you speak with an experienced family law attorney in your area to explore your options.... Read More
