What can I do if my license is suspended even though I was never arrested?

Answered 8 years and 6 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
The police don't have to arrest you even if they charge you. It is perfectly legal to mail a ticket for DWI to you. Moving to another state does not solve the problem. You will never get the arrest warrant or the driver's license suspension lifted until you take care of the ticket for DWI. Hire an attorney who specializes in DWI and have the attorney take care of it for you.... Read More

Being as it has been over twelve years ago, shouldn't the others have dropped off?

Answered 8 years and 9 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
Old DUI convictions don't "drop off" of your criminal record. If you had just 1 misdemeanor DUI conviction, you could hire an attorney to get a first-time misdemeanor DUI conviction expunged from your record after 10 years of good behavior with no other alcohol-related law enforcement contacts. But if you receive other DUIs, you're not eligible for expungement of that first DUI conviction.... Read More

If my boyfriendโ€™s court date was pushed back because the judge had a family emergency, what are our options here?

Answered 9 years ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
Unfortunately, there is nothing anyone can do for your boyfriend if the judge postponed the court date and your boyfriend can't afford to pay the bond.

There is no way these DUIs are going away. They don't just disappear after a certain number of years. And I also believe your son will not be able to avoid jail time. I suggest that you hire an experienced DUI attorney to represent him.

What date and how do I know when probation ends?

Answered 9 years and 7 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
The court does not notify you when probation ends. You can call the court and ask if your probation has been completed/terminated. If it was for 2 years of probation and you completed all other court-ordered requirements, your probation is probably done and your case is closed.

How long does the police have to enter an MIP into the Court System?

Answered 10 years and 6 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
There is no deadline for how long the police have to file the ticket. Sometimes they file their tickets every 2 weeks, sometimes it's every 4 weeks, or longer. If you hire an attorney to represent you, you won't have to monitor it and your attorney will take care of it for you.

What to do if I was wrongly accused of DWI?

Answered 10 years and 8 months ago by Matthew Louis Aiazzi (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
You would be able to challenge this DWI based on both the officers probable cause as well as his lack of blood / breath sample. It is important to note that the officer issuing a citation does not mean that you are going to be charged the DWI. The prosecutor will be the one to file the actual charges. Depending on the officer's report, the prosecutor could choose not to issue the citation. The license revocation is also very challengable because of a lack of probable cause. You would need to file a petition for review in the court where your "refusal" occured which would require a lawyer most likely.... Read More

Will my probation officer find out about my DUI? How?

Answered 10 years and 9 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   4 Answers   |  Legal Topics: DUI/DWI
Judging from the dates you mention, this appears to be a stale question, since it must have been decided in the past seventeen months or so. Your Probation Rules almost certainly tell you that you must notify your PO of every contact with the police (presumably without limitation as to which jurisdiction they are in). It is possible that the state of the offence notifies your home state's Motor Vehicle Division, which might notify your PO. Your best bet is to review closely your Rules of Probation, and follow them strictly.... Read More

How much time will my boyfriend do in jail or will he get deported?

Answered 11 years and 9 months ago by attorney Eric Lee Boehmer   |   1 Answer   |  Legal Topics: DUI/DWI
This depends on his criminal history, but he will very likely serve some jail time and will have a detainer placed on him by immigration.

Do I have to admit that I got a DUI, if one can't really find it?

Answered 12 years and a month ago by Andrew Dean Popplewell (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
To answer truthfully, you would have to answer yes (I am assuming the question says "other than a minor traffic offense?").  The BAC is a class B misdemeanor in Missouri.  The date of the conviciton would be the November court date, the sentence was probably a fine or a suspended sentence and probation.  You could contact the court to receive certified copy of the disposition in your case. This answer does not create an attorney/client relationship.... Read More

Can I get an SIS for DUI expunged and if so, what are the criteria used to determine if this is possible?

Answered 12 years and 2 months ago by Andrea Rogers (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
No, you can't get an SIS expunged. Only convictions can be expunged. With an SIS, you are put on probation, and if you successfully complete probation, there is no conviction at all, so there is nothing to expunge. If you were arrested based on false information and no charges were filed against you, then you can petition the court to expunge the record of the arrest. However, that doesn't appear to be the case in your situation.... Read More

DUI License Reinstatement need PDPS block released

Answered 12 years and 3 months ago by Andrew Dean Popplewell (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
Unfortunately, it sounds as if Washington will not give you a license until you are reinstated in Missouri.  To do so, you need to complete a SATOP comparable program in Washington and have that agency complete the form found here:  http://dmh.mo.gov/ada/satop/faqs.htm.  You would also need to send or call in a $45 reinstatement fee to Missouri (PO Box 200, Jefferson City, MO 65211-0200 or 573-751-4475).  Finally, Missouri would require you to have SR-22 insurance for two years from the start date of the suspension. This answer does not create an attorney/client relationship.... Read More
