Is prison likely for DUI cases and how much time could I get?

Answered 11 years and a month ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
It looks like your problem is both the OWI convictions AND the absconding. I think very substantial incarceration is likely. Just how much depends on the specific facts of the offense, and your own history. The penalties on these things have gotten harsher, but you would be sentenced under the laws in effect when you committed the offenses. I strongly recommend your hiring a good lawyer. He or she can sometimes make arguments which persuade the judge to be more lenient. Good Luck.... Read More

Should I follow the 8 month revocation as ordered by the court or the 6 month revocation stated on the DMV website?

Answered 11 years and 4 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: DUI/DWI
The six-months Administrative Suspension is imposed by the DOT. The 8-months suspension is imposed by the court. The total suspension is 8 months, not 6 and not 14. In other words, you should get a credit for the 6-months Administrative Suspension against the 8-months judicial suspension. Of course if you want to drive in Wisconsin in the future, you'll have to do the AODA (a.k.a. 'mandatory assessment') and comply with the recommendations of the counselor. Good Luck. Drink if you wish; just don't drive afterwards.... Read More

Can they suspend my license due to my failed chemical test they did include in my agreement?

Answered 12 years and 5 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   3 Answers   |  Legal Topics: DUI/DWI
It probably would have best to have a skilled lawyer. In Wisconsin the State often gets three kicks at the cat in an OWI. First, there is an Administrative Suspension if you fail the chemical test. That suspension is 6-months long and you generally can't get out of it. Then, you could be convicted of either OWI or having a blood alcohol content at too high a level. Perhaps the prosecutor should have warned you that the 90 days-suspension would not trump the 6-months suspension. But they usually run at the same time.... Read More
