If you were lawfully arrested for DUI you must provide a sample of your blood or breath under the "implied consent" statute. If you decide not to provide a sample of your blood or breath you may be charged with a "refusal" which carries additional punishment. The law has recently been clarified by the United States Supreme Court to require a warrant to draw blood in a refusal situation, unless certain criteria make getting a warrant difficult or time consuming. If your blood was sent to another laboratory and the results have not yet been returned there are two different paths you should consider. If you are currently in court on your case you should consider pulling your time waiver and setting your case for trial (especially if you KNOW there is something in your blood that will improve the prosecution's case), if your case hasn't been filed, keep your fingers crossed that the results don't come back until after July 17, 2013 when the statute of limitations for misdemeanor prosecutions expires. Under the new owi laws, that went in to effect in 2010, most judges are ordering prison for a 5th owi instead of county jail.
