On the job injury lawyer, what kind?

Answered 9 years and 7 months ago by attorney Stephen Arnold Black   |   1 Answer
You would need to retain  a work comp lawyer, but if your accident was caused by a third party, (even if on the job) you may also have a lawsuit against that third party in addition to the work comp claim..A personal injury attorney could determine whether a third party claim would be viable..   Stephen Black 407-581-2581... May we sue our chiropractor for malpractice?

Answered 11 years and 3 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Possibly, but it would take a clear determination that prior diagnosis would have effected a different result. The only way to have a realisitic idea would be to consult with an attorney immediately, and to obtain a clear medical opinion on whether malpractice occurred and if so if it would have changed the result. If you have any further questions or concerns, you can always contact our office at 1-800-922-6442 for a FREE consultation to see if we can assist you further.... Read More

I am sure there are lots of lawyers, including our firm, that would happy to help you on a hourly basis. Just understand, though, that when lawyers turn the case down on a contingent fee, its usually because of the high risk in investing thier costs and fees in the claim. By hiring a lawyer on a hourly rate/retainer, the risks don't change, just the people the bear them. If you have other questions, please fee free to contact our office at 1-800-922-6442 for a FREE consultation. ... What should I do about being hit by a truck

Answered 11 years and 11 months ago by attorney Thomas M. Bates   |   2 Answers
I agree with my colleague Mr. Groff. I would only add that if in fact, you suffered "head and spinal" injuries you may well incur thousands of dollars in medical bills and have life-changing injuries that you have a right to seek compensation for. I would consult a board-certified civil trial lawyer in your area to discuss your options.... Read More

Possibly. One of the issues that exists is whether you are legally competent. If you are not, there may be several avenue to address your situation. If you are, it may be very difficult to claim you were misrepresented or violated if you didnt speak up at the time, unless the setltlement is waaaaaayyyy out of line, etc.... Read More

Should i seek any legal help [or not] at this time, please?

Answered 12 years and 7 months ago by Mr. John Michael Phillips (Unclaimed Profile)   |   2 Answers
Give us a call.  You have a serious case with clear damages, pain, suffering and sacrifice.  Essentially, insurance carriers try to negotiate every dollar they can, because every $100 means millions in the end to the Board of Directors.  You need someone advocating for you and guiding you through the traps the insurance carriers set. For that reason - and the misinformation by TV lawyers and referral services- is why people should consult lawyers who take the time like on sites like this. Because of the economy, more lawyers are jumping into personal injury and should stick to what they know. Personal injury law REQUIRED knowledge about medical science and biomechanics (the forces on a body in a wreck) far greater and more specific than you'd think. The other side has doctors and millions on their side to say nothing is wrong or fight the claim. If you have any further questions, feel free to email me- jmp@knowthelawyer.com. Check out our website- www.knowthelawyer.com. We'd love to help you. Our number is 800-6-know-law. ... Read More

Injured by a company bike

Answered 12 years and 11 months ago by attorney Mr. Jonathan Hayes Groff   |   1 Answer
Yes. No question. At a minimum you are, or should have been provided with full coverage for the injuries, medical bills and lost wages, under the Club's workers compensation policy. If they failed to have such coverage, denied you benefits under the coverage, or if the policy excluded you from coverage for some reason, they are responsible for your loss, injuries and damages, under our negligence laws. In fact you are likely better off if there was no workers compensation coverage for you, since comp damages can be quite limited.  You clearly need legal representation to determine whether your claim is under workers comp, or general negligence.  As an aside, even if you are stuck with worker's comp coverage, it is possible the manager may be individually liable for providing you with a dangerous and defective bike. it is possible his/her homeowners liability coverage would come into play.  However, if your claim against the club is not limited by Comp, the club itself would be responsible for the negligence of their employee.  Warning: There are significant time limits to present claims under both Comp and general negligence (particularly comp). For that reason you should consult with a qualified personal injury and/or workers compensation lawyer at your earliest opportunity. Good luck.... Read More

Harassment bullied assaulted

Answered 13 years ago by attorney Mark Tischhauser, Esq.   |   1 Answer
Did you actually call the police and did they respond? If not, its almost impossible to have state attorney file charges on an affidavit in that situation, but you can try, assuming you have ID'd the perpetrators so they can actually be charged.

I was injured in a gym. JRFD took me to hospital, concussion, whiplash, vision issues. should I file against the gym?

Answered 13 years and 7 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer
Gyms need to regularly inspect their equipment to make sure they do not pose injury hazards.  You should contact a local personal injury attorney (one in your state).  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. You can use the "Find a Lawyer" service through this website to research personal injury attorneys. Then, visit each attorney's website and select a firm that has a record of successful verdicts.  Please note that by attempting to answer your question, I am not acting as your attorney. I will do nothing further to protect or preserve your interests in the absence of any additional discussion with you about this matter. John Ratkowitz, Esq.
