Am I liable if a friend was injured while helping me move a heavy piece of furniture?

Answered 12 years and 9 months ago by Georges Herman Shers (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
Call your insurance company up and see what their position is. Coverage lasts during the period the policy is in effect; an injury that occurs during that period is covered even if the claim is made later. I am not sure that there would be coverage.

What can I do if I was injured at work and was release by the company doctor and I am still not better to return to work?

Answered 12 years and 9 months ago by Rian Finch Ankerholz (Unclaimed Profile)   |   13 Answers   |  Legal Topics: Personal Injury
This is a fairly common situation, as the company doctors are motivated to cease treatment as soon as possible. If you need more treatment, your lawyer will likely send you to a different physician for a written opinion as to your need for more treatment. Then a demand can be made to the insurance company to provide such treatment. If it is refused, a hearing before the judge may be required. Contact an experienced workers' compensation lawyer.... Answered 12 years and 9 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   12 Answers   |  Legal Topics: Personal Injury
No. An employer is responsible for injuries that occur to employees while in the course and scope of their employment. If you were not an employee, you are out of luck. You may want to talk to a workers comp specialist to determine whether or not you were truly an independent contractor. Sometimes people will call you that to avoid expenses for employees, but if they direct every part of your work day, you may still be an employee, despite what they call you.... Read More

How do I know that it is time to change legal counsel?

Answered 12 years and 10 months ago by Gregory M. Janks (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Personal Injury
You may hire and fire counsel as you wish. You may be entitled to a refund of any fees or costs you paid, or you may owe some fees or costs. Generally, if you owe anything, that can be handled through any new lawyer you hire and perhaps it will be agreed that same can be a lien on any recovery vs. paying anything now. If you signed an Agreement with your lawyer, the terms of that Agreement will likely spell out the issue of costs and fees if you discharge your attorney, so find and read that document. You generally have 1 year to file a PIP suit vs. your insurer from the time any expense in incurred. You generally have 3 years to sue the at fault driver/owner. There could be different statutes of limitations if there are other claims or defendants that you didn't mention (ie: dramshop, product liability, highway liability, etc.). In order to have a viable auto accident case in Michigan you need to be able to prove the negligence of the other driver, that such negligence caused you injury and that your injuries rise to the level of a serious impairment of body function and/or permanent serious disfigurement in order to satisfy the Michigan No Fault threshold requirements.... What can I do if was injured in Best Buy sliding door?

Answered 12 years and 10 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   10 Answers   |  Legal Topics: Personal Injury
Well, in my opinion, as long as the door itself was not malfunctioning, there is no case. To prove a premises liability case, in most jurisdictions, the claimant must prove 1) that there was a specific defect of the property, and 2) that the property owner knew or reasonably should have known about it in advance so as to have an opportunity to fix it before the accident, and 3) that the property owner neither fixed it nor warned of its existence, and 4) that the victim could not discover the defect on their own, and 5) that the defect caused the claimed harm. If you cannot prove all of those things, then you probably do not have a case.... Read More

What can I do if was injured in Best Buy sliding door?

Answered 12 years and 10 months ago by Mr. David F. Stoddard (Unclaimed Profile)   |   10 Answers   |  Legal Topics: Personal Injury
Probably nothing for now. I can't tell if Best Buy would be liable. You would have to show that they are negligent in some way. If there is no defect in the way the door works, or the store did not somehow close the door on her, they may not be liable. More importantly, it doesn't appear that you have any real damages, except perhaps the medical bill. I would wait and see if your child's fear of sliding doors goes away. If it does, then perhaps you could ask that they pay your medical bills. If it doesn't go away, you may wish to consult a child psychiatrist to determine if the child needs any treatment for a mental injury (PSTD or anxiety). If the child has no diagnosable mental injury, then I still believ and damages are too insignificant to justify a lawuit.... Read More

You better believe that you need a lawyer. Get one immediately. If you become ill or injured, and the illness or injury arises out of the employment, that is a workers compensation case. It must be reported promptly, and if the employer won't do it, then get YOUR lawyer to do it.

What can I do about a neighbor who uses a smoker or bar-b-q (a lot) in the summer and the smoke and the smell gets in our home?

Answered 12 years and 10 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   8 Answers   |  Legal Topics: Personal Injury
i suggest that you talk to a local lawyer. There is a concept called a "nuisance," in the law. For example, if I move into your subdivision and decide to start raising skunks, and their "aroma" starts to pollute the air, and since your ability to enjoy your home and grounds due to the "aroma," you could sue and ask the judge to grant an injunction which prevents the neighbor from doing that....
