Am I entitled anything for my loss if I was hurt at work, doctor released me with permanent restrictions and have a loss of motion?

Answered 12 years and 6 months ago by Jason Thomas Olivier (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
There is a specific calculation in the workers compensation code to determine the dollar value of residual disability, which I find to be terribly low. Be sure you have received all money and credit you deserve under the statutes, and contact an attorney to see if you have other remedies.

Can I recover for medical bills, pain and suffering?

Under Michigan law, if the trunk was visible where it projected into the aisle, then you do not have a case. By looking down, if you COULD have seen it (not whether you DID see it), then the fault was yours.

What is an educational malpractice?

Answered 12 years and 7 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
I agree. However, learning is a 2-way street. The teachers cannot open up your kid's head and pour the knowledge into it. The kid HAS to work at learning; the teachers are just the means to that end. The kid probably should have been kept back when in the 1st or 2nd grade. That is a societal issue. YOu should get involved in the school board, go to meetings, and voice your concerns. The big problems are: 1) most kids are not properly prepared by their parents to go to school The TV is not a baby sitter, and that is what it is used for. Kids need to be read to, and then when showing that they are picking it up, to have the kid read to the parent. Ask them if they understand what they are reading. Ask them questions about applying what they are learning from reading to the world around them. 2) kids spend too much time watching TV and playing with computer games instead of outdoor activity, reading books, and interacting with other kids (and adults) face to face. 3) Most parents do not get involved incompelling the kids to study, nor do they go to parent teacher conferences and participate in the learing experience in school. I can go on and on. IT IS NOT JUST THE FAULT OF THE SCHOOLS, even though most schools are, in my opinion, administered by idiots, taught by idiots, and wasting time in the process. If parents gave a damn, and if they voiced their concerns in board of education meetings and directly to the principals and the teachers, things would change.... Read More

What can I do about a misdiagnosis?

Answered 12 years and 7 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   8 Answers   |  Legal Topics: Personal Injury
Well, if you can find a doctor who will testify that it was a misdiagnosis, then you have the basis for suit. Then, you need to establish that you actually suffered (or likely will suffer) damages as a direct result of the misdiagnosis. If the damages are significant enough to justify an attorney spending a bazillion dollars to litigate the case, then you can proceed with a malpractice action.... Read More

How much should I ask for getting hurt on a rusted table that collapsed while I was trying to sit down on it?

Answered 12 years and 7 months ago by James Eugene Hasser (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Personal Injury
It depends on so many things you haven't addressed in your facts such as who owned the table and did they know or should they have known it was going to collapse, not to mention the nature and extent of your injuries. However, even with that info, it would be impossible to answer the question. Settlement values vary widely from case to case and place to place. Consider consulting a personal injury lawyer in your area.... Read More

Do I have a valid case if I was hit by a big rig who admitted fault?

Answered 12 years and 7 months ago by Ronald A. Steinberg (Unclaimed Profile)   |   8 Answers   |  Legal Topics: Personal Injury
First of all, I recommend that you go to the doctor or to an ER. You have no idea whether or not the pain will subside or get worse. If you wait, then when you make a claim they will say that the injuries have nothing to do with the accident due to the gap in treatment. Secondly, the truck is responsible for the damage to your car. Why should you have to pay any money for repairs?... Read More

How long does my attorney have to pay my hospital bill after he received settlement check from the insurance company?

Answered 12 years and 7 months ago by Gregory M Janks (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
An attorney that receives money on your behalf to pay outstanding bills, should pay them promptly (which would typically be within weeks, not months - unless there is some negotiation ongoing with the provider as to the amount of the bill, the necessity of the treatment, whether they will/should accept the same rate they would accept from a medical insurer, etc.). Ask your lawyer when the bill will be paid and why the delay.... Read More

Our teenage son had a bad concussion in a car crash and now cannot play any contact sports, how do we quantify amount for settlement?

Answered 12 years and 7 months ago by Mr. David F. Stoddard (Unclaimed Profile)   |   9 Answers   |  Legal Topics: Personal Injury
First, you need to know how much insurance coverage there is. If it is only $25,000.00, that is likely all you can get. I think the case is easily worth that from what you describe. How much more is difficult to say. It sounds as if it would be worthwhile to hire an attorney for this. One problem is, without an attorney, there is no threat to the adjuster that you are going to take it to court. However, you write a letter the adjuster explaining all of the ways your son and family have suffered. You give them a list of medical bills and lost wages to start, and add a reasonable amount for pain and suffering and loss of quality of life and demand this amount (plus the bills I mentioned). You might think of what it would cost for some activity to replace the joy of playing football, such as music lessons, a car to drive, etc. You might ask for a dollar figure for each wee your son suffers, say $150.00 per week (come up with some way to justify the dollar figure per week).... Can I audio record someone without their knowledge for personal use?

The law varies from state to state. I believe that it is okay for YOU to record what is said to YOU in a face to face conversation. However, if you do it on the phone, I believe that you have to let the person know that it is being recorded. Are you old enough to remember about the Nixon tapes? These were recordings made of conversations in the Oval Office.... Read More

Your husband was driving and you were a passenger? Both of you would testify the other car ran the stop sign? If so, it then becomes you against the other driver. Any independent witnesses? Photos of the scene and / or vehicles?... Read More
