You can always be sued, but generally the only duty you owe to a trespasser is to not intentionally harm him or her. Unless you knew of a dangerous condition and knew the trespasser was there but did nothing to warn him or her, you probably aren't liable. However, if the trespasser is a child and you had something on your land that would draw kids like him or her (a junk car, a pool, etc.), you can be liable under "attractive nuisance" theory.... Yes he can sue. Legally, fault has nothing to do with insurance coverage. But don't bee too concerned; this is why you pay your insurance premiums.

I hope you have been able to find an answer to your question by now.  If you are the at fault driver, you can make a claim for your PIP (&/or MedPay) benefits for reimbursement of your medical costs and/or reimbursement of your lost wages at 80% (PIP only).  These coverages are considered "no fault" so they're yours to claim whether or not you are the at-fault party.  You are not entitled to benefits under your uninsured/underinsured motorist coverage if you are the at-fault party.... I came across your question and saw that no one has posted a response yet.  If you are a homeowner and carry homeowner's liability insurance, you should turn this matter over to your carrier to take care of for you.  Your homeowner's insurance carrier will provide you with an attorney if you have been sued (duty to defend) and will pay any damages that you are liable for up to your policy limit (duty to defend).  Who told you to mediate within 30 days?  Has a case actually been filed against you in a court?  Are you representing yourself pro se in the case?... it sounds like you were treated by doctors under your state's workers compensation system.  You should contact a local workers compensation attorney (one in your state).  It is possible that he may be able to reopen your claim and get you medical care that you require.  He may also be able to submit a claim to get you some compensation for your injury.  Workers compensation attorneys usually get paid a statutory fee if they successfully recover on your behalf, so it shouldn't cost you anything to speak with an attorney to investigate your options.
