Megan's law is certainly a tricky subject and the challenge is that it is never a part of negotiations because it is mandatory with certain charges. There is new Supreme Court law in the Commonwealth of Pennsylvania regarding retroactive application. You should consult with a local defense attorney, one who does appellate work and see if you can challenge the application of the law. One of things you have to do is be careful ignoring it. Failure to register is its own penalty and can carry large sentences in and of its own right. There are many defense attorneys in the Bensalem and Philadelphia area who are skilled with this kind of case. Challenging it will be a timely process, one best handled by an experienced attorney. ... Read More

You better believe it. Having an attorney present for the intake interview is probably the smartest thing you can do. Many people don't realize this, but the intake interview is essential to the juvenile process.

You should report that to the police as Aggravated Assault. It meets the statutory definition and I've seen it charged before. They may not be enthusiastic about pursuing it but you should definitely report it.

Only knowing a limited amount of the facts it sounds as though your mother could have a cause of action against the hospital. What hospital was she at? When did it occur? Did anyone ask for or preserve video?

Bob, its impossible to know who you are chatting/exchanging info with while online. I do think you would have a defense to criminal charges. I would need to consult further with you regarding what was sent, the age of the recipient (if now known) etc.. What county did this happen in?

If you told the police that you were raped when you weren't you could be charged with False Reports. However, in Montgomery County, where I practice, that really never happens because the District Attorney does not want to discourage legitimate victims from coming forward with truthful complaints. If anyone claiming to be a victim is charged with False Reports then legitimate victims might be dissuaded from coming forward for fear that if they are not believed they might be charged with False Reports. More importantly, think of the innocent person that you filed the report on. A rape accusation turns a person's life upside down, can destroy families in addition to the accused, and can even result in suicide. I have one client who was accused of rape this past weekend who is clearly suicidal as a result. If you were mistaken you should do the right thing and notify the police. People make mistakes and the police will generally understand that. The alternative is to be responsible for putting an innocent man behind bars for 5-10 years and then on Megan's law for the rest of his life. Finally, if you were truly mistaken about something and not lying then it would not constitute false reports at all.
