I had let my friend borrow my car while I was on vacation and she received 4 parking tickets. Can I sue her for it?

Answered 13 years and 7 months ago by Lori G. Levin (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
Although a person may sue someone for any perceived grievance, the issue is not whether you may file suit but if you will be successful. From your posting, it is unclear the amount that you are requesting. If it is under the threshold, you may be able to sue in small claims court without an attorney. At any rate, you will need to prove that your friend received the tickets, not you. You will also need to convince the court that she is liable and the amount.   This posting should not be construed as legal advice and is offered for informational purposes only. Does my 18 year old daughter need an attorney for a speeding ticket for going 34 over the speed limit in Illinois?

Answered 13 years and 8 months ago by Lori G. Levin (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
It is always a good idea to hire an attorney for a traffic or criminal case. An attorney will be knowledgable about the system and can counsel your daughter not only regarding the case but also any additional implications.   Recent Illinois case law held that the disposition of a DUI where the defendant was unrepresented by counsel could be used to enhance the penalties of a subsequent offense. Please contact a lawyer as soon as possible. Lori G. Levin Attorney at Law 180 N. LaSalle, Suite 3700 Chicago, IL 60601 312-972-3756 levin@lorilevinlaw.com www.lorilevinlaw.com... Read More

Can I contest this ticket and plead not guilty?

Answered 13 years and 8 months ago by Lori G. Levin (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Traffic Violations
You can always plead not guilty to any and all charges and contest them. The issue will be whether or not the court will allow the prosecutor to amend the charges against you prior to trial. You should consult with an attorney as soon as possible to determine if you have a meritorious case and how best to contest it. Additionally, if the Chicago Police Officer does not appear in court for a minor moving violation, the court does not always grant a continuance and the case is dismissed. Again, please contact an experienced defense attorney to determine how best to proceed. Lori G. Levin Attorney at Law 180 N.    It is unclear from your question whether you were charged with speeding or whether you are facing other charges, such as driving under the influence. Depending of the circumstances, you may or may not have a valid motion to suppress the search of your vehicle.   The law of search and seizure under the Fourth Amendment to the United States Constitution is very complex. You should contact an experienced attorney to determine your best defense and whether any pre-trial motions should be filed and litigated prior to trial.   Please understand that this is a general answer to a question posted on the internet.   Red light photo tickets are not moving violations but are similar to parking tickets. The registered owner of the automobile receives the ticket, not the driver. If you wish to contest the ticket, the procedure should be listed on it. It is never a good idea to ignore tickets as the fines may multiply. There may also be other legal implications.   Please understand that this response is general in nature and should not be considered legal advice. Anonymous: You may not need a lawyer. For something like registration, you can avoid any conviction or fine by showing that you did have registration at the time the citation was issued. Just show it to the prosecutor and, assuming you had it at that time, it should be alright. As for the improper placement, that's a judgment call that's up to you. Some people prefer to hire a lawyer simply for the sake of having someone who can speak to the judge in a professional manner and lay out your story certain way. If you feel comfortable talking to the judge, then you may not want to. If you prefer to have someone there on your behalf or if you're worried about wrong sticker then you may want to consider it. In the end, it's up to you. Please note, this answer is for informational purposes only and is not meant to, and does not, create a client-attorney relationship.... Read More
