Unfair Work Practice

Answered 7 years and 3 months ago by Donna R. Miller (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
You should consult with a workers' compensation attorney as soon as possible.  There are notice and statute of limitations deadlines on your claim.  You will likely need to file a petition to enforce your rights under the workers' compensation laws, but an attorney woudl need more details to be able to help you.     I would be happy to discuss your options with you.   Donna Miller http://donnamiller-law.com/ dmiller@mzelaw.com  ... What recourse do I have?

Answered 7 years and 11 months ago by Donna R. Miller (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
You have the right to a medical evaluation with a doctor of your choosing that the employer/insurance company has to pay for.  This right is triggered once they get thier rating from their doctor.  That doctor can also comment on restrictions that he/she recommends for your condition.  Then, you will have the information you need to evaluate your case.     I do recommend you consult with an attorney about the value of your case and your options regarding settlement.    Donna Miller 515-245-4300 http://www.grefesidney.com/our-team/donna-miller/  ... If I don't agree with what my law firm is advising me, can I take my case out of their hands to another lawyer?

Answered 8 years and a month ago by Donna R. Miller (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
If you wanted to change law firms/attorneys, you can do so.  The transition would be subject to the fee agreement you signed with your current attorney.  Generally, they are paid by the hour for the time they have spent on your case, but you should read that regarding what you agreed to if you cancel the contract.  I think other attorneys will talk to you about your case.     Donna Miller http://www.grefesidney.com/our-team/donna-miller/... Answered 8 years and 7 months ago by Donna R. Miller (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
If you believe your former attorney has acted unethically, you can contact the Iowa Supreme Court's Grievance Commission.  Instructions for filing a complaint are at:   http://www.iowacourts.gov/For_Attorneys/Attorney_Standards__Discipline/Disciplinary_Procedures/ If you would like another attonrey to review the documentation, I could do that and would charge you an hourly fee.  The total cost woudl depend on the volume of documents to review.       Donna Miller 515-245-4300 http://www.grefesidney.com/our-team/donna-miller/... Gene,  If your husband has been injured and a doctor will provide an opinion that the lead exposure is the cause of his medical issues, then you have a valid workers compensation claim.  You should make sure he formally reports that he wants to make a claim, becasue the deadline for doing so is 90 days after he knows his work caused the injury.   If they will not provide treatment or accept responsibility, you will need to find an attorney to help you file a claim.  Donna Miller http://www.grefesidney.com/our-team/donna-miller/ 515-245-4300... I got hurt on the job 2 years ago. Had surgery was sent back to work 2 weeks later. Reinjured same body part.

Answered 8 years and 10 months ago by Donna R. Miller (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
The statute of limitations for your claim is three years from the last weekly payment for your condition.  That deadline is for weekly benefits and impairment.  Your right to medical care for your condition does not expire.     I would need more information - when was the last payment, did they pay you for an impairment (did they get a rating -- a percentage number from the doctor)?  You probably have options that you should explore with an attorney as soon as possible.     Donna Miller www.Grefesidney.com 515-245-4300  ... If you were injured at work, then Workers Compensation may be the only option for payment.  This is the trade off for having workers compensation.  This may not allow suing your employer for your injuries if caused by an injury at work. Depending upon the injury, you may have a limited amount of insurance payment, and this may be your only option for recovery.  I would suggest discussing in detail your case with your attorney to discuss your available options. If your attorney and you disagree on options, you can ask for an opinion from another attorney.... Read More

is there a way to sue workmans comp after they settled.

Answered 14 years and 6 months ago by Robert Eugene Peterson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
You need to contact an attorney immediately to review your case.  A scheduled injury, such as a foot injury, will pay out a maximum amount of money.  However, there could be other payments involved in the case, and an attorney should be retained to review the payments to see if additional funds can be obtained. For additional information on workers compensation, please see my website at www.robertpetersonlaw.com  ... Read More

What options do I have concerning the Injury I sustained at work?

Answered 14 years and 6 months ago by Robert Eugene Peterson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Workers Compensation
It is not unusual to have to obtain an attorney even though Workers Compensation is currently being paid. Often, as the writer stated, the attitude changes when more money must be expended by the insurance carrier, and we will sometimes see valid claims being denied.  An attorney can be instrumental in cutting through the redtape. For more information, feel free to review my website at www.robertpetersonlaw.com... Read More
