There are too many different variables to answer the question of what will happen to specific assets, as it currently is asked.  It depends on numerous factual issues.  Issues such as: the amount currently owed on the mortgage, what other assets you own, the value of the vehicles, and the market value of your home.   As for the attorney's fees, most Chapter 7 attorneys will require an upfront payment of all fees because any amount not paid before the filing will be discharged. I am not aware of any situation in which a relative can have "half custody" of a child, however there are a couple of things you can do. One is to call the authorities (DHS) and ask them to investigate the circumstances of the child. Be aware, however, that DHS might remove the child and not place him with you, and even if they did, they have a legal obligation to work with the mother to get the child returned to her care. Another option would be to petition for guardianship in probate court. This might be the better way to go if you want to keep the state out of it. Also it is much faster. The fact that she cheated on your brother and hasn't ever had a job would not be factors a court would be likely to consider, but the drug use/sales and mental health issues are obviously quite concerning and could be the basis for a court to grant you custody.... I will make two assumptions in answering your question. The first is that the beneficiary is overseas since there would be no need to add a child who is born in the U.S. since the child is already a citizen by birth in this country. As the I-130 petition was already approved in 2010, and the beneficiary is under the F-3 category as the unmarried son of a U.S. citizen (which category is currently backlogged to May 20, 2002, for most of the world except Mexico and the Philippines), I will also assume that the beneficiary's priority date is not close to becoming current. If that is the case, the approved petition is most likely with the National Visa Center (NVC). The NVC is the holding facility for consul-bound cases after petitions are approved by U.S.C.I.S. and are kept there until priority dates are close to becoming current at which time they are sent to the appropriate American consulates or embassies for immigrant visa interview. Either petitioner or beneficiary or legal representative can request the NVC to add the child onto the beneficiary's case. Such can be done via a letter to the NVC and proof of the child's birth. Bankruptcy only will discharge debts in existence at the time of filing.  Therefore, if you have not had the surgery before filing, you cannot discharge the debt once the surgery is performed.   You should consult a local bankruptcy attorney and an employment law attorney to determine what your options are.  Most bankruptcy attorneys offer a free initial consultations to determine if you qualify for bankruptcy, and to determine if bankruptcy is appropriate.  An employment law attorney will be able to determine if workers compensation should cover your surgery. Hello. He would need to get that divorce first. He may try and get it done in the US with the cooperation of his wife or she could do it from Mexico without him going. Once he is divorced, you may marry and process his green card. It is normally OK if he overstayed, however, it will depend on the type of visa and any other immigration issues he may have had while in the US. In addition, you may petition the son as a step-child. If he is still in Mexico, he will need to go through consulate processing after the case is initially approved in the US. You may have a medical malpractice/wrongful death case.  The big question will be whether earlier intervention would have resulted in a different helped him.  If an expert determines that your mother was septic before she was released from the hospital, even if the first group of physicians treating her in the hospital were negligent the case will fail because of proximate cause.  Beyond this, if your mother had end-stage cirrhosis, she had a poor prognosis for that reason alone.  Under the circumstances, there will be a question about whether or not a medical malpractice case is financially viable.
