The 'ol "they" sent me home explanation gets no where unless you can bring "they" to court to confess what you claim "they" did or there is somethinhg like video evidence showing you were there and someone pointing toward the door as you leave. THIS is why you hire a criminal defense lawyer to address such issues and that is what you should do ASAP. ... Read More

Dogs are pets not people. As such they are treated as property. Thier anxieties and "feelings" are not compensable legally. You can sue for the value of the actual damages or possibly the vet bills but you will likely spend more than the value in the effort.

My ex took our dog

Answered 4 years and a month ago by attorney Michael A. Schillinger, Esq.   |   1 Answer   |  Legal Topics: Animal
It's difficult to say without speaking with you further, but, just speaking very generally - you may be able to initiate a suit against him for custody of the animal. One thing that would be important to note is that you indicate that you were the one who paid for the dog, and that you paid for vet bills and care of the dog as well, all of which is in your favor. With that being said, he may also have an argument that you purchased the dog as a gift for him. Your best bet though is to speak with an attorney and go over all of the specific details in your case. ... Read More

How do you remove your parents from your home?

Answered 4 years and 2 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Animal
If they have resided there for at least 30 days, you have to file for unlawful detainer.  I would contact a landlord tenant lawyer and start the eviction process. You may avoid this by trying to talk sense into them saying that if you do file for an eviction, then they will not be able to get a rental because the UD action will go on their credit report.... Do I have to give the dog back?

Answered 4 years and 7 months ago by Pamela M. M. Holcombe (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Animal
If you have had possession of the dog for four years and have been paying for its care for all this time, it is extremely unlikely law enforcement will even investigate sister's claim (presuming this is not simply a bluff).  Have copies of your pet's paperwork such as rabies certificate and vet bills to hand in the unlikely event you get a knock on the door.  In almost every case, law enforcement considers interfamily disputes as to pet ownership to be a civil matter.... What are my legal right

Answered 4 years and 8 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Animal
You should retain counsel to investigate all possible sources of recovery. Was this person on the job? Did someone else own the vehicle that he was driving? Additionally, you have 14 days to seek medical attention or else you will waive your PIP benefits, so even if you are not injured now you should at least get checked out... Read More

what should i do?

Answered 4 years and 8 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Animal
Hi Karl. Sorry to hear about this fiasco. You have a claim against the dog owner for negligence and strict liability, and if the property is rented, then you have a possible claim against the landlord where the dog owner lives. While this website prohibits attorneys from soliciting customers cases, you can always review backgrounds of attorneys on this website and reach out to one of us for possible contingency fee representation, which means you don't pay anything unless you win.... Answered 4 years and 10 months ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Animal
Unless you are willing to spend thousands of dollars in legal fees trying to address this issue, its a non-starter and not viable. This is why "napkin" contracts are rarely of value.

Eviction

Answered 4 years and 11 months ago by attorney Stephen Arnold Black   |   1 Answer   |  Legal Topics: Animal
If your pet is medically certified to treat any kind of disability, then a landlord cannot have a no pet policy as apply to you, pursuant to the fair housing act of Ohio, as well as the Americans with disabilities act. What you need to do is to contact the fair housing administration in Ohio and see if you would qualify for an emotional support animal that could be documented by physicians letter stating that your animal is medically certified to treat any kind of disability that you may have. If you do get such a letter, then it is more Then likely that your landlord has to accommodate your pet. ... Read More

my hoa wants me to remove my emotional support dog from my condo

Answered 5 years ago by attorney Mark Tischhauser, Esq.   |   1 Answer   |  Legal Topics: Animal
Sorry - its NOT your ESA, its your daughters dog. If she wants it up in NJ then she is free to do so and can raise ESA issues as she chooses. Bear in mind, that what you describe is a pet not an ESA as an ESA on ZOOM is not an ESA and if its an undesireable rental breed like a pitbull, its twice as obvious its a sham. You need to be aware that Florida just passed a new law criminalizing false claims of ESA/SA status so tread lightly. Bottom line is you need to send the dog back to her, kennel it, or risk being fined and losing a lot of money or your home to foreclosure. ... Read More
