Answered 12 years and a month ago by Mr. James Paul Peterson (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Child Custody
You may move. Once you have been there six months you may file for divorce there. If he files here before then then you will need a lawyer here.

How do I cancel a custody case I already opened?

Answered 12 years and a month ago by Helene Ellenbogen (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
"Papers for Custody" is not a legal action. I don't know what you filed since a single mother has custody of the child prior to any action to establish the father as a legal father. If the state filed (the county can not file) it is because you receive some kind of government benefit and the state is entitled to pay itself back from the child support the father should be paying. It sounds like the state and not you filed the action so you can't strike it.... Read More

How much longer do I have to pay support?

Answered 12 years and a month ago by Helene Ellenbogen (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Child Custody
There are no cost of living increases in child support. Seeing your son has nothing to do with paying support. You have to pay until he turns 18 or graduates from high school. If the court ordered her not to home school and she is doing so and you can show this is harmful to the child, you need to make a motion for contempt with a clear cut order to enroll the child in school withing 3 days of the date of the order. Motions for contempt often fail because they are not well done and fail to actually make an argument showing contempt. The fact that she lives with her parents or another man is really irrelevant.... How do I file a contempt of court for non child support?

Answered 12 years and a month ago by Ms. Jessica M Cotter (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Child Custody
My first suggestion is that you consult with an experienced family law attorney in your area to discuss this matter. In Arizona there are forms available online for parties who wish to represent themselves. Assuming that there is already a court order in place then here is a link to the Maricopa County Superior Court self service center page that has the appropriate forms and instructions: http://www.superiorcourt.maricopa.gov/SuperiorCourt/Self-ServiceCenter/Forms/FamilyCourt/fc_group_11.asp... Do you find it wrong if I want to start spending the nights in my girlfriendโ€™s with my kids?

Answered 12 years and 2 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Child Custody
You have two separate questions. First is it legal. There apparently nothing in the order that prevents it, so it appears to be legal. Second, is it good for the children. I think you need to listen to the professional about this, i.e. the counselor.

You are not entitled to information, but you should register with the State of Texas Paternity Registry so that she cannot put the child up for adoption without notifying you. Once the child is born you may sue for rights.

How should parents split insurance deductibles for a child?

Answered 12 years and 2 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Child Custody
I think that if she takes you to court, she will find that you are right and she is wrong. Tell her to consult with a local attorney before taking action because it will save you both a lot of money in the long run.

How should parents split insurance deductibles for a child?

Answered 12 years and 2 months ago by Ms. Jessica M Cotter (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Child Custody
You should be speaking with either the attorney that represented you in this matter, or at least a local family law attorney to discuss this matter. In Arizona the general rule is that you would pay 50% of any out of pocket expense specifically relating to you common child. Thus if there was a $50.00 copay, once your are provided with evidence that she paid that copay then you should be reimbursing her $25.00. How this type of issue is handled varies from jurisdiction to jurisdiction, hence the recommendation that you speak with local counsel.... Read More

In Arizona child support is calculated based upon certain guidelines. You should be aware that the income of his new wife is not a part of the calculation. It would be a good idea for you to at least consult with an experienced family law attorney in your area to review the results of a calculation of support. Can I go back and file for arrears if my attorney agreed to dismiss my counter claim?

No, if the counterclaim was dismissed with prejudice, you cannot go back. You might have a claim against your attorney if he went against your wishes. However, if he gave you a copy of the proposed settlement before he agreed to it and you didn't tell him you had a problem with it, that is your fault.... Read More

How can we appeal the judge's decsion about the visitation to my 3 year old daughter of her half sisters?

Answered 12 years and 2 months ago by John F. Brennan (Unclaimed Profile)   |   2 Answers   |  Legal Topics: Child Custody
Form the description given it would appear that the judge has erred in trying to preserve the relationship of the half-siblings. An appeal might be possible depended on the time which has passed since the ruling and it would appear to have a reasonable likelihood of success.

Can child support file a lien against someone who doesnโ€™t have any property?

Answered 12 years and 2 months ago by Mark T. Peters, Sr. (Unclaimed Profile)   |   3 Answers   |  Legal Topics: Child Custody
Just something child support does. You should be asking for your daughter's portion of the SSD as your daughter's custodian.
