There is no duty of good faith or "bad faith" with an opposing party if their lawyer, avoiding a default judgement is possible but you're going to need to file quickly and it may be possible to agree on a decree that provides the terms you are wanting.    It is very common to ask for sole custody but to submit a decree with Joint custody.  I'd recommend you meet with a lawyer in your area to protect your rights.... If your ex-son-inlaw is suing you, some additional information would help in trying to respond to your question.  If you have insurance, it may provide for hiring a lawyer to represent you.  Call an attorney to schedule an itial consultation. Your question was posted under "Power of Atty" it really fits "Family Law" or "Annulment" best.  If there was a mistake, or something that prevented one or both of you from being able to form the requisite intent to enter into a marriage, an attorney may be able to convince the Judge that an annulment is appropriate, otherwise, they often say all the things you said apply to many people who need divorces. Whether your wife obtained her permanent residence through marriage to you or through asylum does not matter in the consideration of whether she can apply on the basis of having been a resident for three years. To take advantage of the rule, she must have been a permanent resident for three years (can apply up to 90 days in advance of the three years); lived in marital union constantly with you during the three year period prior to application; and you must have been a US citizen during the three years. If she meets those conditions, she can qualify for three years citizenship.
