Ws it associated with a criminal case? If so, an attorney can file a motion to return seized property. The Judge would sign an order commanding whoever has it to return it. How much is it worth? An attorney would charge you for their time. Unless the item is worth a significant amount of money (over $500 to $1000), it would not probably be worth it to hire an attorney to help you get it returned. If it is NOT associated with a criminal case, small claims court if its under $10,000 in value. Do not expect that you will find ANY attorney to take on a civil case of this nature on a contingency fee (like in a car accident case where the client pays nothing up front, and the attorney gets paid in the end). If you want to hire an attorney to sue for the property back, expect to pay a retainer fee up front, and the attorney to charge against that retainer hundereds of dollars an hour. The long and the short of it? If its worth a lot of money (or has sentimental value, I suppoer), then hire an attorney to get it back. Otherwise, handle it yourself or let it go.... Read More

my loved one already incarcerated needs help with one of the offenses, can you help?

Answered 2 years and 5 months ago by Mr. John Michael Frick (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
First, this does not sound like a business litigation case, i.e. a dispute between owners of or investors in a business entity.  This sounds more like a criminal law matter. These "ask a lawyer" questions generally are categorized by practice area.  You are more likely to reach a lawyer who practices in the area of law you need if you recategorize your question as in the practice area of "criminal law."Second, you probably need to contact directly an experienced appellate attorney who practices in the area of criminal law in or near the county where the conviction occurred.  A question like "can you help" is too vague to answer in a public Q&A forum like this.  Your loved one really needs to have an extensive privileged conference with a criminal defense attorney so that confidential details pertaining to the case can be discussed without making them public in a forum like this.  Be aware that the time to appeal once a trial is completed is very limited, so he should contact a criminal defense attorney with appellate experience immediately.... You should resubmit this question using the practice area "criminal law."  It does not appear to involve business litigation.Attorneys will only see your question if it is listed as being within a practice area they list in their profile.  Very few business litigation attorneys also practice in the area of criminal law.  So you are targeting the wrong audience.... It isn't clear how this could be a "wrongful death" question, I wasn't aware from your question that anyone had died.  If there was an accident, you should hire a personal injury attorney to file suit on your behalf, if you were injured for the injury, if your vehicle was damaged, for the property damage.  If you are being accused of shooting at someone, you should speak with a criminal defense attorney.  More information is needed to determine why no accurate police report has been created.  If any police report is created but not accurate, you can request that it be amended or corrected. Call some lawyers to schedule an initial consultation.... Read More

Your question was posted under "Family Law" but it appears to be "Criminal".  Failing to appear can itself be a violation of law, especially if already out on an O/R bond.  A person with a warrant out can't just pay the fine, they could contact the court (best through a lawyer) to explain what happened and ask if the failure to appear may be dropped and if they could pay any underlying fine to clear the matter up. Contact an attorney in or near the county where the charge and warrant are.... Read More

I didnโ€™t turn myself in yesterday to jail what should I do ?

Answered 2 years and 7 months ago by attorney Dale Gribow   |   1 Answer   |  Legal Topics: Criminal Defense
You need to contact the lawyer who represented you. A bench warrant has been issued......if you show up in court tomorrow, the judge could put you in jail with an additional charge stemming from the failure to appear. You want your lawyer to pave the way for your surrender. Every courthouse is different, as is every DA and judge. It is also important to know the facts of the underlying case. Did you get a sweetheart deal that the DA may want to revoke? What is your record? Prior BW?... Read More

If you are convicted of theft of a value $750 - $2500 it is a class A misdemeanor, it is punishable by up to a year in jail, and up to a $4000 fine. A theft conviction on your record could also cause you to lose job and educational opportunities. A lawyer can help you avoid those consequences. In many instances we have been able to even get theft charges dismissed (after the client compliee with some conditions). Many of us offer free phone consults during business hours. Good luck.... You will need to reach out directly to a criminal defense attorney. We cannot directly solicit your business. If you read client reviews, it will give you a good idea what kinds of cases the attorney specializes in. Some of us do a large portion of our practice defending weapons offenses. I would suggest speaking with a few attorney and hiring who you trust to defend your son.... Read More

Hard "maybe." Although it is not a conviction, you plead guilty when you were placed on deferrwd adjudication. In the future you can have this offense sealed, it will remain visible to state agencies, like the TX State Board of Educators, and school districts. You should anticipate you will be required to disclose it, and may have additional scrutiny when applying for teaching positions. Although not a prohibition, a misdemeanor theft, even though you are not convicted, will create hurdles if you want to pursue a career as a teacher.... Read More

Answered 2 years and 8 months ago by attorney Diane Buerger   |   1 Answer   |  Legal Topics: Criminal Defense
Without seeing the police report, it is impossible to definitely know why you were arrested.  However, based on legal knowledge and experience, an attorney can make a good educated guess. It is possible that you were arrested because the law enforcement officer who had you perform field sobriety exercises (often referred to as "tests") concluded you were under the influence of alcohol or some other intoxicant to the degree that your normal faculties were impaired.  In Florida, you can be convicted of DUI in two different ways:  (1) by having a BA (blood alcohol) reading above the legal limit; or (2) by your normal faculties (or ability to perform certain tasks - such as touching your nose or maintaining your balance) being impaired.  Number (2) can result in your arrest regardless of any BA reading.             ... You cannot run and hide from your parole and have it discharge on its own while you are on the run.  Why anyone believes this could be true is incredible to me. Your discharge date is meaningless once you go on the run, and a motion to revoke it filed. You will NEVER finish parole - it is frozen once the motion to revoke parole is filed, and no matter how long beyond your original discharge date you run, you will NEVER discharge from parole....
