A child born to a married couple is presumed to be the child of that couple. If you get divorced, you may address this issue and have the child declared not to be yours if a blood test confirms that you are not the father, or if your wife agrees.

You will need to address the issue during your divorce and unless the court allows you to move the child with you, the child will have to remain in MI. The reasons you stated in your question are not enough on their own to convince a court to allow the move. There are specific statutory requirements for a court to rule in your favor. You can file a motion with Circuit Court in the county where you reside and ask the Judge to change the baby's name. This will likely be granted if the father does not object or is not involved with the child. You must notify the father of your request and notify him of the court date.

If there is a court order regarding parenting time then you must follow it unless and until a motion is filed to modify it and a new order is entered.
