What do I need to do once my ex cohabitates? My UOSS states that I can stop alimony after cohabitation for greater than 60 days.

Answered 9 years and 9 months ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
IT would be extremely risky to simply stop paying. I would suggest filing a motion and then start putting the money into an escrow account to show that it is available if necessary. Good Luck, and be sure you have strong evidence of cohabitation.

WHAT CAN I DO WITH A SISTER WHO HAS POWER OF ATTORNEY FOR MY DAD AND DOES NOT ASK THE OTHER 3 SISTERS OUR OPINIONS BEFORE SHE DOES SOMETHING?

Answered 9 years and 10 months ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Unfortunately, your sister is correct. Your best bet would be to try to convince your Dad, if he is stll competent, to change things to involve the others of you. If he is not, you are stuck with things, but your sister does have to use her own judgment for the best interests of your Dad. If she crosses that line, you can go to the Probate Court to try to get her ousted. I hope you don't need to do that. Good luck.... Read More

Do I have to make the kids accessible to the non custodial parent during his vacation time

Answered 9 years and 10 months ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
If you asked and he told you no in some provable way (email, text, with disinterested witnesses) and you made your plans after that, I would set all of that out in an email and let him know that the children will be with you BECAUSE he told you he did not have plans. Then the burden should be on him to go to court if he wants to make a big deal of it. Good Luck. If you don't have proof, you may have a "he said, she said," and you may have trouble. ... Read More

Can a child be mandated to continue visitation after they turn 18?

Answered 9 years and 11 months ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
No one will force him to go at age 18. It will be u to him. Your client shouldn't do anything to hinder visitation, but she will not be forced to force him to go.

How can I stop my child's grandmother from interfering with the raising of my children.

Answered 10 years and a month ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
if you have strong enough evidence, you might be able to get a Personal Protection Order to keep her away from you and your daughter. On the other hand, depending on how old your daughter is, you may risk losing more of her if you formally fight with someone she likes and is old enough to find ways to be with. Good Luck.... What rights do I have regarding my 15yo son who is allowed to spend nights and have sex with 16yo girlfriend at his moms and also her parents homes?

Answered 10 years and 3 months ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Unfortunately, I see little that you can do that will be helpful in the way you want help. If you raise these issues formally, your son, his girlfriend, and perhaps his mother and her parents might get into some trouble, but it certainly will not lead to your son wanting to spend time with you. At his age, regardless of the court orders, kids will end up spending their time where they want to spend their time, so you are unforutnately very unlikely to get more time with him unless he wants that. Sorry. I would be very careful here unless you want your son to get into trouble that could follow him for a long time.... Read More

Answered 10 years and 3 months ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
How did your brother do this? Did he forge her name? Did he have her power of attorney? It does not seem proper for him to have done so in any event. You should ask him how he can justify what he has done, and, if he ignores you, you will need to get the courts involved. You should not just wait, but move ahead now if you can, especially if your mom is available and will say she did not want to give him the property.... Read More

My Girlfriend is trying to take my son to another state without consent?

Answered 10 years and 3 months ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
You need to get to a lawyer and get to court as soon as possible. If she leaves and takes him with her, there is a chance that the custody matter will happen in a far away court, which you do not want. If you file here and now, the case will be decided here. That doesn't mean you will win, but it will certainly be easier and less expensive to have it handled. Good Luck.... Read More

Can I be forced to sell my home in a divorce if I am not able to refinance on my own.

Answered 10 years and 4 months ago by David J Hutchinson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Family
Possibly. It depends upon your husband's situation. You can ask him, or, if he is unwilling, you can ask the court to let you keep the current financing in place. That will, of course, significantly impact HIS ability to finance anything else if he is looking to do so. Good luck.
