How much of settlement should I receive?

Answered 12 years and 11 months ago by Michael R Parker (Unclaimed Profile)   |   16 Answers   |  Legal Topics: Personal Injury
There is no way to know what the amount of settlement you should receive is based on that information. It depends on the insurance policy, your medical bills, pre-existing injuries, future pain, future medical bills, loss of earnings, loss of employment, etc.

I fell in a store parking lot, hurt knees and sholder should I get a lawyer?

Answered 13 years and 3 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You should contact a local personal injury attorney (one in your state).  Personal injury attorneys take  cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. You can use the "Find a Lawyer" service through this website to research personal injury attorneys. Then, visit each attorney's website and select a firm that has a record of successful verdicts. If you are unable to find a lawyer who meets these qualifications within your state, sometimes you may contact an out of state lawyer who can refer you to a qualified attorney in your state while providing support related to the issues of medicine. Click here and here for more information about me. Please note that by attempting to answer your question, I am not acting as your attorney. I will do nothing further to protect or preserve your interests in the absence of any additional discussion with you about this matter. John Ratkowitz, Esq. Can a US lawyer represent me in Bermuda?

Answered 13 years and 6 months ago by attorney Michael A. Ferrara, Jr.   |   1 Answer   |  Legal Topics: Personal Injury
The simple answer is no.  You must find a lawyer in Bermuda to represent you.   I'm sure you can do a search and find one who handles these cases.    Sometimes, however, you can sue in the USA with a US attorney if you are injured in a foreign country.   For example, if you fall, or are a victim of an assault in a Mexican Hotel, owned by a US Company you can sue here.    The choice of law will probably require Mexican law to apply.    Also, if the Mexican resort is not a US company, you still may be able to sue in the USA if they used a US travel agency and directly marketed to you in your state.   It's an interesting choice of law issue.   The NJ Supreme Court recently ruled that an auto accident in South Africa could be brought in NJ because the plaintiff lived in NJ and the responsible driver worked for a US company.   ... Answered 13 years and 8 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Do a google search of law firms that prosecute asbestos claims and call them to ascertain whether there are any exceptions to the statute of limitations for these kinds of claims. My gut tells me that there probably are, although I do not know if you will meet the criteria. Someone who specializes in asbestos claims should be in a position to give you an answer to this question. They take these cases on a contingency basis which means you only have to pay if you succeed.  Additionally, initial consultations are free. Can my brother sue a nightclub for neglience?

Answered 13 years and 9 months ago by John Joseph Ratkowitz, Esq. (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
It is hard to tell you whether you have a viable negligent security case without delving into all the facts surrounding the fight. The fact that there were many fights on the premises suggest that the facility should have been aware of the possibility and perhaps provided more in the way of security.  You should contact a local personal injury attorney and run the facts of the case by him.  He can advise you whether you have a viable cause of action. They take these cases on a contingency basis which means you only have to pay if you succeed. Additionally, initial consultations are usually free. Please note that by attempting to answer your question, I am not acting as your attorney. You most certainly can contact the owners of the parking lot for the insurance information.  However, what this does not address is whether you have a valid claim against them and therefore, entitled to have anything paid (including medical bills).  I suggest you contact an experienced personal injury attorney in your area and give them the details of the accident so that he or she can determine the liability on this matter. You can only make a claim for injuries against a homeowner's policy if it was an accident - for example, a defective step caused you to fall and hurt yourself.  If this was a fight, this is considered an intentional act and not covered by insurance.  Sounds like you are out of luck. The answer to this slip and fall question relies totally on the circumstances, and you have not provided much detail unfortunately.  If you fell because of negligence or wrongdoing on the part of the hotel, then you potentially have a claim for any damages and injuries that you incurred.  However, if you fell due to your own fault, then you have no case.  Bear in mind also that every state has a statute of limitations that allows you only a certain amount of time to bring a claim.  If you are interested, you should contact an experienced personal injury attorney in your area immediately.  Best of luck. Your sister should hire an experienced car accident attorney.  Regardless of the criminal charges against the drunk driver, your sister has a civil claim for her injuries and damages against the drunk driver.  It appears that the drunk driver might be covered by his father's auto insurance policy, but there will probably be a fight by the insurance company denying coverage.  Last year we handled a drunk driving case in which our client was awarded $18 Million by the trial judge, and then we had to fight the insurance company for the coverage, ultimately collecting for our client.  Your sister has suffered a significant injury and has a strong case on liability, she should hire an experienced attorney to help her gain appropriate compensation....
