A concussion can be a very serious injury. I would strongly suggest you contact a lawyer. I would also be concerned that the insurance company is not taking responsibility. The first consultation is free and you do not pay a lawyer unless you recover. I would be more than happy to discuss this with you in more detail. ... Read More

That is very short notice, but in order for an attorney to consider representing you in this case, we are going to want to know things, such as the extent of your injuries, your total medical bills, and how the accident was caused.
This answer is given in accordance with the laws of Virginia and may not be applicable in any other state. It should not be construed as legal advice, as that would require a more thorough analysis of all of the facts involved in a specific case. You likely have an uninsured motorist claim against your own insurance company. When you buy automobile insurance in the state of Virginia, you usually purchase a kind of insurance called uninsured motorist coverage (or UM coverage), for this exact situation. Uninsured motorist coverage provides compensation for medical bills, lost wages and pain and suffering when you are injured by the negligence of another driver, who does not have insurance. Probably not any more. All states have statutes of limitations which control how much time you have to file a claim or a law suit. Michigan allows 3 years. The only way to get around it is if you were a child at the time of the accident, and you are not older than 19 now (under Michigan law), or if you were mentally incompetent until just recently. Otherwise, you are probably barred by the statute of limitations.... Read More

Under Virginia law, if your shoulder was injured in a sudden, identifiable accident in the course and scope of your work, and your employer has the necessary number of employees, then you may seek coverage under the Workers Compensation Act. If, on the other hand, the injury is due to days and weeks of cumulative lifting or "repetitive trauma," then it may not fit the requirement of a "sudden accidental injury," and you may have to seek payment of your medical bills through your health insurance. It is unclear if by the term "Workers Compensation" you mean the Virginia Workers Compensation Commission, whose judges hear these cases and then rule for or against the injured employee, or you simply mean the insurance company for your employer. Calling an experienced workplace injury lawyer who actually tries and wins cases at the Virginia Workers Compensation Commission, and who you can actually watch doing so, is probably your smartest move. I hope that your shoulder is healing and that you are getting good medical care while you are performing light duty at the warehouse.... Read More
