Can I sue the funeral home for putting on my husbands death certificate that we were divorced at his death, and we are still married?

Answered 6 years and 8 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
The problem is not the funeral home but the insurance company. The death certificate is not the only document that the insurance company looks at to determine if your were married or not. I would contact the funeral home and ask them to write a letter stating that the death certificate was incorrect when it stated that you were divorced. Send that letter along with other documents establishing that you were married. If they continue to deny the claim, hire an attorney to sue the insurance company.... Read More

Answered 9 years and 4 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
I want to make sure that I understand. You said "in our settlement...." Does this mean that you settled your claim with USAA or did you just make an offer of settlement to USAA and they refused and were not able to settle? If you did not settle, then I would think that you could sue in Murfreesboro since it is not a suit against the other driver, where you would have to file suit in Louisville.... Read More

Is it still required by law to get three estaments on a damaged car in TN

Answered 9 years and 9 months ago by Patrick Johnson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Insurance
I want to make sure that I understand the facts first. Another driver damaged your car and their insurance company says that the cost to repair the car is $3,000 which is more than the value of the car, so they want to pay you $3,000 which I assume is what they say the value of the car is. You claim that the car is worth $6,000 and want them to fix it. There is no requirement in the law that they have to give you 3 estimates. In Tennessee, your damages for the value of a damage vehicle is what was the value of the car before the accident minus what is the value of the car/salvage value in its damaged condition. If the car was worth $6,000 before the accident (undamaged condition) but only worth $1,000 after the accident (damaged condition/salvage value), then your damages are $5,000. The best way to convince them that you are right is to look around on the internet and try to find comparable prices for  what your car was worth before the accident.... Read More
