Yes, you can. If you have a notice to appear that is a court order. Not obeying court orders can be deemed contempt of court.

some courts do require counseling if they say you have to go, you have to go while you are there, you can do what you want counseling is really for reparable relationships and, where there are kids involved, to offer guidance for how best to do a divorce with kids.

Non-refundable earnest money deposit

Assuming both parties signed, this opinion is based solely on the facts as presented and reliance on this is at your own risk: 1. it appears there is a binding contract 2. the inspection WAS not a contingency of the EMD. 3. I would have to see the agreement but as I read what you posted, the acceptance of another non-contingent offer from another buyer might trigger returning the EMB from Buyer 1. You probably can read the Agreement as meaning you can hold the money until you have another offer on the property. 4. IF the house does not sell or you get no other offers, so long as you in actual good faith do nothing to prevent the sale to any other buyer, at some point, when it is clear the house is not selling, the EMD can probably be deemed forfeited.   Again this is based solely on what has been presented and is not my formal legal opinion and no attorney client relationship is created by this answer. Your employer has almost certainly broken multiple laws. If money for Social Security, FICA or State income tax is withheld on the printed paycheck, that same amount of money had better be remitted to the respective government. Failure to do so is embezzlement and possibly a felony. It sounds like the employer is at or near bankruptcy. Not sure if the employees can manage the company but you should offer to buy it from him for a dollar because that dude is toast.... Read Answer

Assuming your wife is able to knowingly sign the deeds it is no problem. Both of you would have to sign both deeds (assuming both properties are deeded to you both as Husband and Wife. It is not clear what your situation is. If you just bought a unit in a Condo, all assessments and fees should have been negotiated as to whether they were paid by the seller or pro-rated at sale. You may well have a claim for fraud against the selling agent and broker as well as the selling. Did you have have your own realtor? Was the selling agent representing you? Thare are a lot of questions but, if you bought the home 'as is' you might not have a case especially if you waived inspection. A closer look at your closing packet will reveal if you have a case. Sue the landlord for back rent in district court. Not entitled to rent if he has no renters certificate (look this up) or if the place isn't heated in winter. Demand a refund. Also, if they took a security deposit and did not tell you what bank account they put it in they broke another law. At this point you probably need a new place and should move out.
