Would her biological father be required to pay back child support if he signs away his rights in order to go through with the adoption?

Answered 12 years and 5 months ago by Jonathan Edward Shimberg (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
The biological father would not be required to pay back support unless you tried to obtain that before an adoption. If you seek child support he will likely seek visitation, which a court may grant. If you merely seek for your husband to adopt the child and give the father appropriate notice he may do nothing and your adoption will go smoothly. If he objects to the adoption, then you can seek child support. Your act of adopting does not require him to pay anything whatsoever.... Read More

Yes, bank accounts can be frozen for child support arrearages. Also, just because the child has reached age 18 doesn't automatically stop child support, you or your attorney need to bring a motion to discontinue child support (of course, the arrearage matter would still need to be dealt with).... What can be done if Supreme Court rule 922 was violated?

Answered 12 years and 8 months ago by Jonathan Edward Shimberg (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
By filing the complaint, you have forced your attorney to ask leave to withdraw. A conflict now exists between the two of you. Whether his conduct is appropriate is no longer relevant. What motions have been filed and still have not been ruled on are not clear. If there was a motion to change custody to you and it has not yet been ruled on, then it can be argued that such a motion is also a request to terminate support. Unfortunately rules are not always strictly followed in a divorce context. There could be many reasons why this has not been concluded some of which may have a reasonable explanation. 508 requires you have a copy of your agreement. You should have been given one when you hired the attorney.... Read More

If you have an ex-wife, then the judgment for dissolution of marriage should make provision for custody and visitation, If it does not, then you can seek relief from the court that entered the divorce. Unless there is a court order for visitation, you have no enforceable rights, if one of you has custody of the children.... Read More
