How do I go about getting custody of my daughter back from my mother after they have closed the case?

Can I terminate ex's rights?

Terminating parental rights is not easy and not a do it yourself project unless the other parent is out of the country and or he or she agrees to terminate their rights. You can try to get sole legal and physical custody at best which is similar to the terminating of parental rights as it will give you exclusive control over the child life. It would be wise to go after the $10,000 arrears and see if he will be willing to settle the deal by terminating his parental rights. When you have are on a fixed budget and can't afford a lawyer, one of the things you can do is find a lawyer that is willing to be able to work with you on a payment plan or be able to provide you legal counsel and or document preparations services. We do this for most of our clients. You can also represent yourself and just pay a lawyer for legal advice and guidance. Another thing you can do in your situation is for look for free or low-cost lawyers, like probono attorneys. You should try to pursue unpaid child support which can also help you pay a lawyer. If there is no custody order and you are the biological father then you have as much of a right to have the child with you as she does. If a custody order has been entered then you would need to file a motion to modify custody. If the child is not living with her then you could also file a motion to modify child support as well. He may request a DNA test but if the child is his then he will be required to pay child support whether or not he chooses to see the child. In Kentucky, every biological parent is required to financially support his/her biological child. There may be a question as to how much should he pay but you will need to retain an attorney near you if you want to make certain he isn't ordered to pay too much each month. If no legal relationship has been established then the child support action is probably an action to determine paternity as well. Your question sounds simple but is really the exposition of a very complicated situation. If your husband is not seen his child for over two years and has not been supporting her it is possible that he could have his parental rights terminated. As the father of the child he is liable for support, whether or not he sees his daughter and whether or not his parental rights are terminated. Rights and obligations are separate and distinct.
