Removal of fence

If the line the fence is on has been effectively treated as the boundary for at least 15 years, then that trumps the survey, and the fence has become the lot line. Check with a good local attorney. Good Luck.

Have you been in touch with her to discuss this? Try it. What part, if any, did she play in getting, training, and taking care of the dogs? Does she really care about them or is this just to hurt you? Where are you located? Where is she located?

Answered 9 years and a month ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer
You have not made yourself clear enough. If you had a bankruptcy Discharge in 2011, the dischargeable debts you had when the bankruptcy was filed are gone. Those incurred since then are not.

Can I collect on a judgement that is 10 years old?

Answered 9 years and 2 months ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer
I assume that you mean it was entered on 2/19/2007, right? Was it entered in Michigan or California? If in Michigan, you have at least until 2/17/2017 to file a new case based upon that Judgment in which you will get a new Judgment, which will be good for another 10 years. Then, you will have to get someone in California to Register it there and have it enforced. If the original Judgement is from California, I THINK you have the same time frame to get the Judgment renewed in California. In either case, you should be all right if you move quickly. Good Luck.... Read More

being sued by a bank

Answered 9 years and 2 months ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer
You should at least consult with a lawyer comfortable with commercial civil litigation, but it may turn out that there is really nothing a lawyer can do for you. Another possibility is to consult with a bankruptcy attorney just to see if you have any options in that area. Good Luck.

There is probably a lawyer out there somewhere who will take such a case, but you really have no actual damages, so there does not look like much to it to me. Just one man's opinion, though. Good Luck.

Can my stepson take us to court over money I kept for him?

Answered 9 years and 8 months ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer
Your question does not contain all of the necessary facts. The money you were "keeping" for him-- was it his? In any event, he can certainly sue, but, if he damaged your property, it seems that he should not win if he does sue. Good Luck.

Is there any legal recourse for me in the case of my ex-husband alienating my three adult daughters against me?

Answered 9 years and 11 months ago by David Cvengros (Unclaimed Profile)   |   1 Answer
Given the current age of the girls, legal custody issues appear to be moot.  Issues rearding access should be taken up with the girls since they are both adults.  As for a legal calim of slander or a similar lawsuit, the legal basis of a such a claim and any limitations period cannot be evaluated on the facts given, but I beleive that your options are very limited at this point.... You must balance your willingness and ability to pay a lawyer against the likelihood that, without one, you may not be as successful. Sorry, but there is not easy answer. Perhaps you should interview a couple of potential lawyers about what they would do and how they would do it. Good Luck.... Read More

What is the statute of limitations for damage to personal belongings?

Answered 10 years and a month ago by David J. Hutchinson (Unclaimed Profile)   |   1 Answer
Generally, it would be 3 years, but consider the costs involved before going forward. It may not be worth the hassle. They will certainly say that they thought the vice was for sale, and it will not be easy to show that it was not. Good Luck.

Your question is missing some key facts. Normally, these days, a spouse is entitled to a survivorship interest in a pension unless they sign off on it, and they are in no way compelled to sign off. If you think your spouse MUST sign away their rights, you are mistaken. If the question is something else, please explain. Sorry for your frustration.... Read More
