It is always best to be represented by an experienced criminal defense attorney. Such a lawyer will understand the court system and can help you evaluate your options. It is never wise to speak with a prosecutor without the benefit of counsel. There may be collateral consequences to taking a plea. Please contact a criminal lawyer as soon as possible.   This posting is for informational purposes only and does not constitute legal advice nor establish an attorney-client relationship between the parties. Can a person be arrested for intent to commit homicide?

Answered 12 years and 5 months ago by Kenneth Oliver Wang (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
No.  You can not be punished on the basis of bad thoughts only.  There must also be some criminal act.  Under 720 ILCS 5/8-4, the Illinois Statute for attempt, the person who is planning must take a substantial step towards the commission of that offense.  For example, its not enough to think and say you're going to blow people up with a bomb. You have to go out and buy bomb components or put them together into a bomb.    ... Read More

my husband was arrested and had no bond because of a probation hold, however now he has a $50,000 bond does this mean they lifted the hold

Answered 12 years and 5 months ago by Kenneth Oliver Wang (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
It depends. No bond is usually because of a parole hold, not a probation hold. That usually means your husband can bond out on the new charge for $50,000, but the probation hold will still prevent him from being free. He will typically just be transferred straight to the Illinois Department of Corrections. There's a lot of potential circumstances that would change how this question and answer turns out, but this is the most usual case.  ... Read More

What happens to my court case now?

Answered 12 years and 5 months ago by Kenneth Oliver Wang (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
It depends on what other evidence there is. You sound like you have several issues.  If you never gave him permission to search your car, you may want to file a motion to suppress.  The fact that he got fired is potentially exculpatory, but that does not automatically mean your charges are dismissed. For example, if there's a video recording of you saying you knew the drugs were in the car, you are still going to have a difficult time. You should talk to your attorney. They should know what to do when this kind of situation pops up.  ... Read More

Should my case be dismissed? And what evidence is need to convict for Unlawful Consumption of Alcohol by a Minor?

Answered 12 years and 5 months ago by Kenneth Oliver Wang (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Defense
They can charge you with it if a reasonable person would believe you were drinking. Usually just your breath smelling like alcohol is enough. Other facts could be you stumbling, vomitting, glassy/blood shot eyes, or slurred speech. Your accusor does not need to be present until your trial. If you do not understand what is going on, you should hire a private attorney, or if you can not afford one, you should request a public defender.    ... Read More
