There has to be some type of evidence for the D.A. to file DUI charges. A full review of the complaint, police report and discovery packet needs to be made before an accurate answer can be given. I am assuming that your son has an attorney, in which case, this question should be posed to his attorney, since his attorney knows more about the case than anyone else.
