That's a weird Montana law and I don't know Montana law, but what I take from it is that they have something less than a DWI. So, even if they report it to Texas it won't satisfy as a prior DWI in Texas. And Texas will treat it the same as Montana. Not going to your court date is never a good option. With regard to a felony DWI (or any other felony or misdemeanor) a warrant will be issued for your arrest, your bond will be revoked (and if there is a bond company, they will be assisting in finding you), and you will be unable to get a license. For a Public Intoxication charge the officer is not required to administer a Breathalyzer test. they may rely on their own observations to determine probable cause for arrest, such as stumbling, slurred speech, or other acts.
