Sounds like you were actually convicted, not put on a deferred probationary status. Although your counsel departed the firm, your file should still be among their files if this took place only a few years back. If the charge came up in the background check, you have a case number. The clerk should be able to find your expungment papers under that case number, as should the prosecution via their closed files. In OK, the state bureau of investigation receives copy of expungment orders. If you are elsewhere, your jurisdiction has a similar agency. Expungement is based on eligibility, which is determined by a multitude of factors. The main inquiry is basically how long has it been since the offense and are you disqualified on other grounds (i.e. too many other offenses). A Class B misdemeanor has a 4 year waiting period in Utah, a Class C has a 3 year waiting period, and a Class A has a 5 year waiting period. Not much chance of getting a pardon. If you have kept your record clean you should be able to get an expungement if your charges were in state court. An expungment of a state court charge should restore your right to own a gun.
