Your friend may have a cause of action against the complex.  To bring a claim, the at fault party must do something negligent.  Negligence here would require the complex to breach a duty of care to your friend, and because of that breach your friend sustains injuries and damages.  For example, if the complex was renovating the roof of the complex and failed to prevent falling materials (herein a brick) and the brick landed on a person causing injuries, the injured party could bring an action against the building. Yes. No question. At a minimum you are, or should have been provided with full coverage for the injuries, medical bills and lost wages, under the Club's workers compensation policy. If they failed to have such coverage, denied you benefits under the coverage, or if the policy excluded you from coverage for some reason, they are responsible for your loss, injuries and damages, under our negligence laws. In fact you are likely better off if there was no workers compensation coverage for you, since comp damages can be quite limited.  You clearly need legal representation to determine whether your claim is under workers comp, or general negligence.  As an aside, even if you are stuck with worker's comp coverage, it is possible the manager may be individually liable for providing you with a dangerous and defective bike. it is possible his/her homeowners liability coverage would come into play.  However, if your claim against the club is not limited by Comp, the club itself would be responsible for the negligence of their employee.  Warning: There are significant time limits to present claims under both Comp and general negligence (particularly comp). Are you suggesting that the doctors failed to diagnose a broken neck, or are you suggesting they failed to diagnose another condition that caused you to fall and break your neck? The problem with plastic surgery cases in general is that nearly all doctors require patients to sign extensive informed consent paperwork that explains that the results from the surgery are not guaranteed. Under the circumstances, it is difficult to prevail in these cases. The debate usually centers on whether the results from surgery were within the range of reasonable rather than whether the defendant doctor was negligent.
