I need help getting my money back from a car place

Answered 3 years and 8 months ago by attorney Hon. Max L Rosenberg   |   1 Answer
You need a consumer defense attorney.  Was the car under warranty? Did you notify them in writing of the problems and give them a chance to fix it? It might fall under lemon law act.  The best attorneys for this type of matter are either Eric Lindh Foster and/ or Dan Blinn.  Good luck... Read More

Did you sell the vehicle AS IS?  Did you make any representations regarding the mechanics or condition?  What needs to be fixed?  Was it a pre-existing condition?  Your question is vague and needs more detail for me to offer an answer.

Post Office

Answered 5 years and 7 months ago by attorney Hon. Max L Rosenberg   |   1 Answer
You may  attempt to sue the United State Postal Service by having your attorney file a lawsuit in federal court. However, you can't really sue them for a lost item as  The Post Office enjoys special legal protections as a government agency, unlike its compettitors. The 1946 Federal Tort Claims Act (FTCA) protects the USPS from being sued for “[a]ny claim arising out of the loss, miscarriage, or negligent transmission of letters or postal matter.”   Sorry you do not have a case. ... Charge off

If they are false reporting to your credit report and you can show an actual drop in your score as well as other real world consequences,  you may have a Fair Credit Report Act matter. (FCRA) This is a federal law that requires the a correction by the bad reporter after your first contact to them and also allows for actual damages when the reporting is not removed or continues to be wrong and damaging.  There are few lawyers in Connecticut handling FCRA.  I would reccomend Daniel Blinn in Rocky hill, Sergei Lemberg in Stamford, and possibly my office in Stratford.  Good luck. ... construction work in the way

Answered 6 years and 10 months ago by attorney Hon. Max L Rosenberg   |   1 Answer
I am sorry that you are the victim of personel roller carts in your way.  I do not even know what you mean by "personel roller carts". Furthermore, no one should be throwing over you arguments to move baby carriages out of the way.  And finally, if people continue to leave roller carts and baby carriages in your way on the bus, you can either ask them to move or you can enter from the back or front doors of the bus to get around it.  There are no laws to protect you from people bringing their carts on the bus and accidently getting in your way. Good luck.... Read More

You absolutely can hire an attorney but it may not be worth it depending on what the stakes are.  You should look for an attorney with a good handle on Fair Debt Collection Practices Act (FDCPA) as well as CCPA for Connecticut creditor law.  There are not a lot of consumer attorneys out there.  Dan Blinn in Rocky Hill, Sergei Lemberg in Stamford, and my firm in Stratford have the type of background that you likely need. Good luck. I also called you twice but you left a wrong number. I think debt negotiation will likely be a better avenue for you and yield better results.... Read More

Can they do this?

Answered 7 years and 8 months ago by attorney Hon. Max L Rosenberg   |   1 Answer
That is very possible depending on the value of the vehicle. Leases are funny like that. I had a similar problem with BMW.

It sounds like a very difficult case to prove. I am also not sure that they did anything untoward or illegal and finally, I don't know what kind of damages you would have or how you would quantify them.  I think more information is needed to determine if there is a viable case here.

If I were in your position I would make a demand to the electricity company for the amount you have overpaid. If an agreement cannot be reached, I would file suit.  This is a matter of civil litigation and would best be handled by an attorney who has dealt with utility companies before and has experience litigating such matters.  Please feel free to contact me for further information.... You can sue, but you should understand that you will be limited in what you can claim.  In order to determine if you have a truly viable lawsuit an attorney would need to know how badly injured or sick you became.  Depending on how sick/injured you are is generally the basis for your damages. Why should the customer be responsible since the bank misled them by making the amount of the deposit available?

Answered 14 years and 4 months ago by Ms. Loretta Salzano (Unclaimed Profile)   |   1 Answer
Oh my. So you were the victim of a fraud and that you sincerely thought you won so much money and started to spend that fake check?  That's an awful lot of money and a sad tale of woe. The reality is that you had the benefit of the money, and I bet that your account agreement with the bank holds you liable in this instance. Please consult your account agreement or ask the bank for a copy. Because you were a victim of fraud, I bet the bank will work with you to work this out. You don't say how much you spent, and it's entirely possible that the bank wants your house as collateral to ensure that you'll pay them for the amount you spent.  Another option might be to try to get the money back from those you paid. You don't say who you paid and for what, so that might not be an option. I don't know enough about the scam to know what chance of recovery you have and to whom it should be reported. Start with your local police and at www.ftc.gov.  The bank might already have asked you to fill out a police report.  I suspect that the fraudsters are long gone and that you'll be left holding the bag on this one as you did spend the money.  That is better than being out of money that you gave to the fraudsters which is also a common occurrence. Best of luck in resolving this matter and remember, if something sounds too good to be true, it probably is.  ... Read More
