This is not an overcharge, it may be an early payment, you should clarify with the landlord and get on a schedule that you both agree to. Also if rent is due on the 1st it should be paid so that the landlord has it on the 1st, auto payments sent on the 5th is a late payment regardless of the grace period.... Read More

Yes, you can be liable for your entire lease if you leave early unless you have made arrangements with the landlord in writing to let you out early. It might be helpful if you had someone that could rent instead of you to present to the landlord.

A tenant has the right to withhold rent for certain reasons. But even then, this right is very limited. For instance, if a pipe blew, the tenant may be able to fix it and withhold the cost from rent. In this case, there is an alleged dripping. The tenant may have an argument that you are costing her additional water bill fees (assuming water is her responsibility), but even then she should only withhold the difference. You technically don't need to enforce a court's order. If you are concerned, however, you should evict the Tenant, but only if your lease allows you to evict for such reasons.

Call the police, take video or photos of any illegal activity. If you are a tenant of the building, there are procedures to force the landlord to bring eviction proceedings against the illegal activity and if the landlord does not after proper notice to the landlord you would have the right to bring a proceeding against the offending tenant. You should discuss this situation with a NY landlord tenant attorney to examine all your options.
