Highly unlikely.  You would have to prove a constructive firing. This is not a good start to a case if you have to ask this question. However, you mention an employment contract so this is encouraging. In order to properly answer this question, I think you should consult with an attorney that deals with employment law. My partner handles these matters frequently and we would be happy to hear from you, should you require further assistance.... Read More

I was threatened by a business partner of my company

If you are still employed, I do not see any damages and I cannot think of how you would have a case.  Are you imagining a case for intentional infliction of emotional damage against the debtor? I do not think that is feasable either.

Can I get free consultation?

I believe you are having a common misunderstanding of the Summary Process. What you are probably looking at is a standard Notice to Quit with a 3 day time on it.  This is just the begining of the process.  The best advice I can offer you is that you need to hire an experienced attorney to defend you in this matter.  They will be able to drag out the process to give you more time or  perhaps negotiate a deal advantageous to you.  Please feel free to contact us regarding this, as we regularly handle matters such as these. ... Can I sue my former employer for illegal wage withholding?

Answered 13 years and 4 months ago by attorney Hilary B. Miller   |   1 Answer   |  Legal Topics: Wrongful Termination
It is difficult to understand how you were harmed by your  employer in these circumstances. You were apparently over-advanced on commissions. Your employer offset the over-advance against your draw. As a result, you received exactly the right amount of commissions. This is not a winning fact pattern for you. Moreover, you need to separate the issue of termination from the correct computation of your wages -- your employer had the right to terminate you for any reason or no reason at all. The economic hardship you are suffering appears to be the result of the termination, not correction of your draw amounts.... Read More
