Great question. The language on the deed is controlling BUT depending on what the PA says, and when it was signed, you might still have a breach of contract issue. What is certain is 15 years after the purchase, by virtue of adverse possession, they would have no claim. A court might see a claim in equity but courts would have to see a great wrong against the other side. You paid them for the property, it was their job to make sure the deed was right. If you're the US Citizen, it's not going to make a difference. The only criminal conviction that would disqualify you from sponsoring your fiancé would be crimes under the Adam Walsh Act. These crimes involve sex crimes against minors. Even if you were convicted of murder you could still sponsor your fiancé. If you received a letter from the Court, and not a lawyer's office, it sounds like you have already been sued ro collect this debt. If you have been sued and do not defend the case, a judgment may be entered againat you for the amount they claim is owed, plus interest, their costs and attorneys fees. I think you need to sit down with your lawyer, in person, and review the case. It does appear that the lawyer who left the firm might have neglected your matter. On one hand, you need them to complete the case for you. Changing firms mid-case never works (cases that change lawyers have a significantly lower success rate for clients). On the other hand, you can rightly ask them how they would feel if a law firm handled a matter for them personally with this situation. Then ask how they will make this situation right for you. I think this tells them you fully understand the the situation and that there is definitely grounds for them to cut their bill to you as a way to make it up to you. Be firm but diplomatic. Lawyers are usually smart people and their reputation matters more to them. They should see this as a case where they need to make it up to the client.    Best of luck to you.... Read More

When and how you receive the summons are important because if you fail to properly respond in time, you can essentially lose the case withot having an opportnity to respond. IN bankruptcy, ALL Contracts may be affirmed in the bankruptcy. Contracts that  have a negative impact to the estate can be broken and contracts which the State wishes to maintain and be reaffirmed.  I never recommend that people do their own bankruptcy and I highly recommend that you have legal counsel do it for you.  Properly planned and done, the bankruptcy can be financially liberating, however it without a solid claim behind it, I have seen bankruptcy become a treadmill where the bankrupt keeps needing to refile every 2 or 3 years because the first bankruptcy didn't work and once they are on the slippery slope, they can never get themselves right.   I also always recommend wherever possible that one does a chapter 7 bankruptcy and avoid chapter 13 as much as possible.  Again a bankruptcy attorney is the best person to talk to about this....
