I got charged with Misdemeanor Larceny under $200

Answered 3 years and 9 months ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Criminal Law
Under Michigan law, applying the facts as your describe them, the larceny charge would not stand as you cannot be shown to have had the intent to steal. If someone throws money, they cannot say they don't expect others to pick it up. Sadly, the disturbing the peace charge will probably stand. The prosecution will be able to show you intended to interrupt the event and actually did disrupt the event. It is a misdemeanor, expect a fine and community service. It is best to consult with your court appointed attorney on this.... Read More

tshirt creating

Answered 3 years and 9 months ago by attorney Gilbert Borman   |   1 Answer   |  Legal Topics: Intellectual Property
If you use anyone else's intellectual property you have to pay for it or have their permission to use it. You can copyright or trademark your own designs. Copyright is the cheapest. Trademarks cost money but, if your design becomes valuable, gives you more rights to what you created.

It is always best to have a lawyer draft your will. The problem is what you write may not do what you want it to do. In comparison to the cost of a lawyer preparing your will, the cost in the future of not getting it right might be that your intentions for your estate don't happen.

how do I withhold rent due to ignoring apt repaits

Answered 3 years and 9 months ago by attorney Gilbert Borman   |   1 Answer
send a certified letter to landlord: identifying the escrow account (separate account, suggest a credit union) you are putting the rent into the estimated cost of the repair the number of times you have contacted them about the issue and their response advise you will negotiate on how much rent to pay the rent once the repair is done   cautions- landlords will treat this as a declaration of war they will probably NOT renew your lease after this   good luck... The answer is maybe.  If one of you is under the age of 18, you are likely to be considered underage in the United States. Your legal ability to marry will depend on the laws of the state where you plan to get married. Each of the 50 U.S. states sets its own rules, and you will need to research them. For example, you may find that in one state you must be 18 years of age to marry, while in another you can marry younger if you can show the consent of your parents. Assuming that you are of legal age to Marry,  you still must get around the obstacle of filing a financial affidavit establishing that you have the minimum level of income to sponsor your fiancé. ... Can my lease not be renewed out of retaliation

Answered 3 years and 10 months ago by attorney Gilbert Borman   |   1 Answer
The only way you can get out of this is if Yes directs their manager to drop the case or you convince the judge to drop it. It is kind of wacky for a company to countermand their onsite management so many times and the management keep at the tenant. Legally, their managerhas the power, until her boss tells her to stop.  ... Read More

Itemized list

Answered 3 years and 10 months ago by attorney Gilbert Borman   |   1 Answer
The statute gives the landlord a certain number of days to send the list. nothing in the statute prevents them from updating. Depending on what court you are in a judge might see this as unfair.

I have a officer and his wife is the judge

Answered 3 years and 10 months ago by attorney Gilbert Borman   |   1 Answer
It is not clear to me what you are asking. You seem to be describing a situation in which an officer's wife is the judge in a matter, my answer is to that fact situation: This is called a conflict of interest and the judge should recuse herself from the matter. Advise the court through a motion to recuse. If the judge refuses to recuse, appeal that decision.   Good luck... Read More

Can landlords add things to itemized list for damages?

Answered 3 years and 10 months ago by attorney Gilbert Borman   |   1 Answer
they have to be honest and correct in their billing. put any diasgreement in writing and give them a set period of time then take them to court- they have a duty of fairness in the contract and, if they are just trying to make stuff up to keep the security deposit, the court will see their actions as breach of contract and allow you to get some if not all your security deposit back. If they did not give you a receipt for your security deposit when you made the lease, they have already broken the law... Read More
