I'm in the middle of a divorce and I feel my lawyer isn't on my side what can I do

Answered 8 years and 5 months ago by Jeff Grandjean (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
First of all, you always retain the option of changing attorneys if you are not satisfied with the work your current attorney is doing for you.  As far as how, your best bet is to contact some attorneys and set up a consultation to discuss your options, and if you find someone you like and can work out a fee arrangement, hire them and they will replace your current attorney.  I would recommend you actually find and hire a new attorney before releasing your current attorney, as you don't want to end up unrepresented.  Please feel free to contact me if you would like, or another lawyer on here.... Friend broke my jaw at his house, can I sue for medical bills

Answered 8 years and 5 months ago by Jeff Grandjean (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You may possibly have a case, the issue is you would need to establish some type of fault for the injuries on either your friend or some dangerous condition on his property, and given that you don't remember what happened, that could be difficult. I do recommend you speak to an attorney if you have more details as they could likely assist you in deciding whether you had a good case.... Read More

You should definitely speak to an attorney as you may have a case both against the other driver in the motorcycle accident if your son was not at fault, but also a possible medical malpractice against his care provider for releasing him too son.  Too give a good opinion, more informatin is needed since these types of cases depend a lot on the specific facts, but I would definitely recommend pursuing it as your son likely has a case.... When a mortgagee forecloses pursuant to a judicial foreclosure and judgment is a junior New Mexico tax lien against property extinguished

Answered 8 years and 10 months ago by George Giddens (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Foreclosures
Yes, assuming the holder of the lien is joined in the foreclosure action.  Although the lien is extinguished against the property that is foreclosed, it is not extinguished as to other properties owned by the taxpayer, and personal liability for the tax is not eliminated.

How do I get a family to move out?

Answered 9 years and a month ago by Stephen Dean Ingram (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Real Estate
Are they paying rent?  Assuming no written lease, deemed to be month-to-month.  Give them notice of termination of tenancy under landlord-tenant act, followed by suit in metro or magistrate court (as appropriate) to evict them.  Once get judgment, sheriff can physcially move them out.  Going to be difficult since they live with you, apparently.   This is for informational purposes only, is not legal advice, and does not create an attorney-client relationship.... After the fact charges

Answered 9 years and a month ago by Stephen Dean Ingram (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Real Estate
Landlord had to give you accounting within 30 days after last day of lease with deductions from deposit.   If not, landlord forfeits right to keep any of deposit, and forfeits right to go after you for alleged damages to property.  If he did give 30-day notice, probably have to fight him in metro or magistrate court over whether damage charges are legitimate.   This is for information purposes only, is not legal advice, and does not create an attorney-client relationship.... Yes.  Heirs, which are defined by the probate law of the state where probate is filed, have the ability to file in probate court to seek information, to contest an executor's actions, to seek court supervision of an executor, and to remove an executor.  Good luck.

The best action is to gather together and keep in a safe place all evidence that you and he have had a bona fide marriage. When the divorce is finalized, you can submit the I-751 Petition to Remove Conditions on Residence with all the proof of your marital relationship. If U.S.C.I.S. is convinced through the documentary evidence and/or interview with you that the marriage was bona fide, you would be allowed to have your conditions removed on the green card. It is certainly possible to enforce your claim.  However, assuming that you have no basis to sue the debtor in Australia, the debtor may be able to force you to appear in the US, for deposition and/or trial.  This is not a certainty, as you may be able to obtain a summary judgment based on undisputed facts set froth in an affidavit, and also the Court may allow you to be deposed by video conference, but it is possible, and, along with retaining an attorney, may be more costly than the matter is worth.... where can can i find the I-94 number on the visa?

Answered 9 years and 4 months ago by attorney Alan Lee, Esq.   |   1 Answer   |  Legal Topics: Immigration
The I-94 number is not on the visa. It is given to a person upon arrival in the US by Customs and Border Protection. You can access the number along with your entry record by going to https//94.cbp.dhs.gov.if you entered in May 2013 and later in any legal manner other than by land. Prior to that time, physical I-94 cards were given to all legal nonimmigrant entrants to the US with the numbers on the cards.   Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. My friend has been here for 30 years from mexico how does he get his residency?

Answered 9 years and 5 months ago by Wendy Barlow (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
There is no simple path based upon length of time in the U.S. Eligibility for permanent residence will depend upon more detailed information about his immigration history and ties to the country. Most individuals obtain residence through family-based or employment-based immigrant visa petitions. You can read more about immigration options at http://myattorneyusa.com/immigration-to-the-usa.... my brother in law was arrested by ice he did go to court but i did not receive any latter from ice tha he had court

Answered 9 years and 10 months ago by Wendy Barlow (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
When someone is arrested by ICE he/she is typically served with a Notice to Appear. This Notice to Appear may have court date set or not. The immigration court actually sets the date so notice comes from the immigration court. Your brother-in-law can call the immigration court to find out his next hearing date. It is important he not miss an immigration court hearing as he can be ordered removed in his absence. I'm trying to get my husband here from Egypt on a spousal visa and I don't know where to begin.

Answered 9 years and 10 months ago by Wendy Barlow (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
You process to bring a family member from overseas. The first step requires you to file an immigrant visa petition along with required supporting evidence with USCIS. Once this petition is approved, the case will be transferred to the NVC after which your husband will apply for an immigrant visa. He will submit a visa application online. He will also need to submit supporting documents to show he is eligible for the visa. Eventually, he will be scheduled for an interview where a consular official will approve or deny his visa. You can read more about the process at http://myattorneyusa.com/family-immigration.... Read More

Your wife's ex has no power to unilaterally remove her as an obligor on the car loan, as this would prejudice the lender (co-signers benefit the lender, giving it additional security for its loan).  Such a change would require the lender's consent, and it has no reason to consent.  Your wife's ex could theoretically repay the car loan, possibly taking out a new loan on his own for that purpose, but he may not have the ability to do that, even if he wanted to.  Moreover, absent a court order (such as a judgment of divorce) or an agreement which requires the ex to get the loan transferred to his name alone, I don't think he is obligated to do so....
