Can they deny me having them if I live in an RV?

Answered 8 years and 8 months ago by Helene Ellenbogen (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Child Custody
It sounds to me like 5 children are way too much for space and CPS will likely not approve of a 13-year-old boy in the same room as two little girls.

If you have not started divorce proceedings your husband has no duty of support. You don't say if you're separated. You need to file for the divorce and then give notice of relocation. If you move when nothing is before the court, the father can file to have you return the child. Of course, if he's moving to another state, he's not likely to do that. You need to provide a clearer picture of what's going on to get a full answer to your question.... Read More

Answered 8 years and 8 months ago by Helene Ellenbogen (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Divorce
You don't say if you were divorced. If you were, you just marry. If you're in the middle of a divorce, you drop the case by entering an agreed motion and order to strike the case.

If I was caught stealing, will it be on my record?

Answered 8 years and 8 months ago by Thomas Edward Gates (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
You can do a criminal check yourself. It does not matter what the value is of the item stolen to be charged. It sounds like you either had a diversion or stipulation order of continuance. If either, your docket would show the charge and disposition. A background check would not show the charge or disposition.... Read More

As long as a child is in high school (up to the age of 21) a parent has to pay support. Clearly, if she is enrolled part time the school must allow that. There are many high school programs that are geared at giving students some work experience by reducing their course load and requiring them to work part time. The fact that a child is working part time does not impact the support obligation.... Answered 8 years and 8 months ago by Thomas Edward Gates (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Criminal Law
Look at the sentencing order. If it states no alcohol or drugs during your probation, then yes, you would fail a test. You will also be subject to random testing during this period. Failure can lead to actual jail time.

What is the earliest date for filing for citizenship and how long does it take for processing?

Answered 8 years and 8 months ago by Lana Vladimirovna Kurilova Rich (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
If you obtained your green card through a U.S. citizen spouse, you can file now. If you obtained it by any other means, you may file 90 days prior to your 5th anniversary of being a green card holder. Your five years will be on 2/22/2018, so you may file 90 days prior to this date.

If my sister filed a relative petition for me and my visitor visa has expired, what form can she file again so I can legally gain employment?

Answered 8 years and 8 months ago by Lana Vladimirovna Kurilova Rich (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
There is nothing she can file. In fact, you should leave the U.S. as soon as possible because you will not be able to adjust status through your sister with an expired visa. Only spouses, children and parents of the U.S. citizens can do that. Everyone else must be in valid status, or this filing could be for nothing. You have to wait for your immigrant visa outside the U.S., or you must be in some other valid status at all times. I am afraid that you may have already created a problem for yourself if you overstayed your visa and did not change status to some other valid one. Waiting for a green card from a sibling may take over a decade! During this entire time, you must either be in some other valid status here or you must wait outside the U.S. This is the unfortunate reality.... Read More

If we get married, will I be able to return to the US after the wedding?

Answered 8 years and 8 months ago by Lana Vladimirovna Kurilova Rich (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Immigration
If you get married here, you should not leave the U.S. until you get your green card (unless it's an emergency, and a wedding or a prepaid vacation or something are not considered emergencies). Otherwise, if you leave, you will have to stay outside the U.S. until your immigration process is complete and you get your immigrant visa to return to the U.S. (which could take a year, give or take).... I don't think it is an illegal invasion of your privacy. However, it may be a breach of the covenant of quiet enjoyment. You are entitled to the peaceful and quiet use of the premises you are renting. If the interference is bad enough that you must move out, you could have a claim for construction eviction. Such a claim usually requires that you actually move out first, though. I would talk to your landlord about the issue first, see if quiet times are being observed. If not, I would contact a local attorney for further assistance.... Read More
