You may have a claim against the child's parents for negligence. If they own a home, then its more than likely that their homeowners insurance policy will provide coverage if you file a claim.

"can i sue as a caregiver for emotional stress

Answered 5 years ago by Andrew Allen Popp (Unclaimed Profile)   |   1 Answer
The legal cause of action you are discussing is "intentional infliction of emotional distress."  They are traditionally fairly difficult cases to prove, and you must have significant measurable damages.  The behavior of the offender must be "outrageous."  From what you describe above, it does not sound promising.  However, your best option would be to sit down with an attorney in your area to get all the facts and then give you an opinion based on the whole picture. Best of luck.... Read More

The key factors are the requirements of the police to insure public safety and to insure that no laws are being broken. In your situation, the police have no knowledge of what is happening and are investigating to insure that no one is hurt and no laws are being broken. Concomitant with that reasoning is the 'self protection' of the officer. Please call if you have any questions. Ed Dimon, Esq. 732-797-1600 ... Read More

I'm sorry that happened to you.  Circle K is a grocery store?  I don't know of any law requiring them to let you use its bathroom.  However, I would suggest if you have a problem, you might consider wearing an adult diaper if you are going to be away from a bathroom.  Most elderly citizens have to wear diapers.   ... Did your mother teach you:  "Sticks and stones will break my bones, but words will never hurt me."  I don't know if you are a man or a woman but it really shouldn't matter.  (1)  You could definitely file for a "civil harassment restraining order," meaning she could then face criminal charges if an order is granted and she continued to harass you when you are merely doing your job.  You could merely call police and have her arrested.   (2)  If she is trespassing on your property, then you could file a civil complaint for any damages she causes including emotional stress.  However, you should know that judges and juries hate neighbors fighting cases.  So you would have to show severe emotional problems such as an expert witness psychiatrist testifying, medical expenses and lose work damages as a result or some type of monetary loss.  A civil harassment restraining order may be the easiest court filing against her to get her to stop.        ... So I responded to this a few days ago but just wanted to add that most of these cases are taken on contingency fee, which means you don't pay anything unless you win the case. I would be happy to talk with you about your case. So if your freedom of speech is being restricted based on the content of your viewpoint, in a public forum, then the court will analyze the restriction based upon the strict scrutiny test. This strict scrutiny will invalidate their action taken against you unless there is a compelling state interest and that is advanced in the least restrictive means to achieve that compelling state interest. If in fact they cannot prove this , Then you have a case against them and can recover attorneys fees as well as injunctive relief.... Read More
