In California, one party can choose to unilaterally seek a divorce, even without the consent or agreement of the other spouse. There is little to no legal recourse, thus your only real option would be to pursue alternative methods, such as couples counseling, to try and salvage the marriage. However, even if you do not want the divorce, it would be best to consult a family law firm which offers free consultations, such as my own, in order to protect yourself in the event that she does file for dissolution. Often the spouse who does not want the divorce goes to court without an attorney, thinking he or she can negate the request based on the lack of desire for the dissolution, yet the judge will still grant the divorce, and often on terms which the party is unprepared for.... I suggest that your brother get smart and gets an attorney to finish this divorce. The sooner the better if he wants to start a business.. There are things he can do to protect the business from being pulled into the divorce, but this would require knowledge of what's involved and most importantly, clear documents between himself and the lenders of money in the family. If he doesn't have the money for an attorney, then he isn't ready to start a business either. If the whole decree was vacated, not just some part of it, then you do not have the capacity to marry since you are not divorced. That is very rare, so check to see what was actually vacated. Likely it was just some part impacting debts or assets.

If it is community property, your spouse has as much right to it as you. You can always ask the court to keep your spouse away. If you can provide sufficient reason, the court may grant your request. If you have an attorney, work with him or her about the issue.

That would depend upon how many years the marriage is. If the marriage is more than 5 years, you will probably have to pay some sort of alimony for some defined period of time. If your decree was put together by a competent person, there would be a dead line by which the house has to be refinanced or put on the market. I assume there is not, which means you can either go to court and ask the court to set a deadline, the court could easily say no since it wasn't bargained for at the time or you will just have to wait....
