Have you reported this to Wal-Mart?  If you have not yet, I would contact Wal-Mart, tell them about the incident and that you would like to report the incident officially.   They will likely want the receipt and pictures.  They may even request the can and the insect.   I'm not sure an actual lawsuit would be the best route for you unless you were seriously damaged by the insect being in the can of peanuts.   Lawsuits require actual damages, meaning you suffered a monetary harm.  However, you might be able to work something out with Wal-Mart (with or without an attorney) and get compensation for this incident without having to file an actual lawsuit.   The best thing to do at this time is report the incident and go from there.  Best of luck. If you are attacked in your home you can kill the burglar and you do not have to retreat or even be attacked. The minute they break in you can kill them. You cannot use a gun if that is a crime to possess it but you can use any other weapon. You do not have to retreat from your own home.
