Can I sue if the medicine my mother takes for her breasts has a side effect of causing uterine cancer?

Answered 9 years and 10 months ago by Jill K. Whitbeck (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
You cannot sue. Your mother may be able to sue, based on product liability. She would need to meet with an attorney who has experience with such cases, as they are very complex, time consuming, and expensive. Taking on the pharmaceutical industry, and winning, is not easy.

If his attorney isn't licensed to do business, can I sue him for any legal fees related to me filing my answer with the court?

Answered 10 years and 4 months ago by Jill K. Whitbeck (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Whether or not his attorney has a business license is entirely irrelevant to your present legal proceeding. Even bringing it up will make you look petty. Respond to his lawsuit and get the matter done.

After 4 years can I file a workers comp case? How?

Answered 10 years and 8 months ago by Georges Herman Shers (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
Why have you waited so long? ?Normally, you must file a claim for an on the job injury within one year of the injury or the date of the last providing of benefits. There are some exceptions, but you do not provide enough information for me to know if you qualify. ?If your employer knew you had an injury, he was supposed to file paperwork. ?You need to immediately go to some local Workers' Compensation applicant's attorneys to see if they can do anything for you. ?There will be no charge unless you hire them.... Workers Comp. has become a highly specialised area of law. Locate a lawyer who practices this area of law, and ask him or her. To find such a lawyer, you can try the net (e.g. Avvo.com and other such sites), the yellow pages, or the lawyer referral service of your state bar. Sorry I could not helpbut the answer will not be hard to find.... Read More

Are you sure you didn't file a worker's comp case? You said you have been to several doctors (the employer doesn't send you to a dr) How are your medical bills being paid? Did you lose time from work? If so, did comp pay you anything? In NY you have 2 years to file a claim. If you have not done so within 4 years, I can't figure out why.... Read More

After 4 years can I file a workers comp case? How?

Answered 10 years and 8 months ago by Mr. Thomas C. Bulman (Unclaimed Profile)   |   7 Answers   |  Legal Topics: Personal Injury
The four year old injury is probably dead. In Montana, an injured worker has 30 days to report an injury to a supervisor and one year to file a written claim for compensation. If your job slowly caused degeneration and aggravation as you continued working, but now it is too serious to ignore, you may qualify for occupational disease coverage. Harms that a job causes over more than a single day fall into this category. Call the Department of Labor in Helena and file an OD claim. Don't use the old injury date because you apparently continued working so that injury must have been stable. The new OD is why you need medical treatment now.... Read More

Me and my girlfriend got into a hit and run car accident, how much should we get?

Answered 10 years and 8 months ago by Erven T. Nelson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
That depends on a lot of factors. For soft tissue injuries, insurance companies are getting much more strict in Nevada. We try to get up to 3 times the value of the cost of the medical treatments and prescriptions, but lately it has been harder to get that amount. It also depends on whether there are lingering injuries or disabilities, lost employment, etc. Make sure that you do not settle too soon, particularly before you have finished all treatments, visits, procedures, medications, etc. You will probably get more if you hire an experienced lawyer. Let me know if you need a referral in your town.... Read More

I do not understand your question. If he settled the case, the case is settled and the other party can no longer maintain a civil suit in any state.

Is sufficient grounds exist to file a case against DCSS for unnecessary infliction of mental anguish and emotional distress?

Answered 10 years and 9 months ago by Jill K. Whitbeck (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
I do not see any claims against DCSS, as they were only doing their job and likely have immunity for that. However, you may have a claim against the woman who named you as the likely father. Remember, DCSS didn't pull your name out of a hat . . . they were told you were the father and went from there. Your claim isn't worth much for a couple of reasons. First, you did not suffer any tangible damages. Second, the woman who named you may not have the resources to pay any claims and this is not something that her insurance would cover.... Read More
