You can't "serve any time" unless you are being criminally charged by the Prosecutor - which would be an entirely separate legal action from being sued by the injured person for personal injuries in civil court. If sued in civil court, you turn the Summons and Complaint that are served on you to the car insurer of the vehicle you were driving. They have their lawyer defend you and respond to the case. Whomever is the titled owner of the vehicle you were operating may also be sued pursuant to the Michigan Vehicle Owner Liability Statute.... Read More

This answer does not create an attorney/client relationship. No lawyer should be making a settlement, in my opinion, without his client's consent. I am a S.C. lawyer and board certified S.C. internal medicine physician. Read your retainer agreement in this case. It sounds like you could possibly have a case for legal malpractice. In my opinion no settlement is final and binding on the client without the client's permission.
