You and your son have a right to change lawyers if you are not happy with your representation. It would be helpful to know more about the case to provide you with an opinion as to what your options are.

If I am not happy with my son's representation after a car struck him, now what?

Answered 10 years and 7 months ago by Mr. Thomas C. Bulman (Unclaimed Profile)   |   11 Answers   |  Legal Topics: Personal Injury
Why are you dissatisfied? If your son agrees with you, he should find a new attorney, but he should talk to his current attorney first and see if the problem can be corrected. Switching attorneys will slow the resolution of the case.

Who do we sue if son was killed as a passenger and driver was drunk?

Answered 10 years and 7 months ago by attorney J. Michael End   |   2 Answers   |  Legal Topics: Personal Injury
You can sue the driver, although collecting a judgment may be difficult. Otherwise, you can make a claim against your own automobile insurance company under the uninsured motorist coverage, assuming your automobile insurance relates to your son.

What could I do if my car was impounded?

Answered 10 years and 7 months ago by Georges Herman Shers (Unclaimed Profile)   |   4 Answers   |  Legal Topics: Personal Injury
I do not know why the car was impounded since you could legally drive it perhaps if not much time had passed since you got the car. But if a great deal of time had passed, you can not drive an unregistered car without plates so it was reasonable to impound it. That you answered without paying attention to what the officer asked [but you then say you misunderstood him, so your story is inconsistent] is really your fault.... Read More

What could I do after being subpoenaed?

Answered 10 years and 7 months ago by James Eugene Hasser (Unclaimed Profile)   |   5 Answers   |  Legal Topics: Personal Injury
A letter is different than a subpoena. I'm not real sure what you got there. You might try calling the lawyer that sent it and explain your situation and see if you can't work something out to your mutual satisfaction. If you can't, you'll need to get a lawyer to try and quash the subpoena, if that's what it is. Good luck.... Read More

i am sorry about your child's injury. Playground accidents can be difficult. You would need to show that the school were negligent and of that they lacked adequate supervision for the children on the playground. Also, since the claim is against a municipality, you need to check the statutory laws as to notice to a municipality. In Wisconsin, the notice is 120 days for serving written notice of your claim. If you don't, the claim is forever barred.... Read More

Can I sue my dentist if my bone graft did not take?

Answered 10 years and 8 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
Yes, but it may be against Nature and not against the dentist. The key question is not was the procedure successful; that's not guaranteed. The question is whether the dentist's treatment fell below the standard of care, and whether that breachif there was onewas the direct, natural, foreseeable cause of your injury.... Read More

That's a good question, but I wouldn't worry about it. If I were you, I would simply make collision claims and let the insurance company worry about getting their money back if they want to. Good luck.

Is Store Liable for Injury?

Answered 10 years and 8 months ago by attorney David B. Karp   |   1 Answer   |  Legal Topics: Personal Injury
These cases can be very difficult to pursue. Insurance companies routinely deny the claims and force individuals to file a lawsuit; later, at mediation, they will offer "nuisance value" to settle, forcing the person to settle for pennies or go to trial. Unless you have photos of what made you fall or independent witnesses with you, most personal injury lawyers shy away from these type of cases,  unless you have catastrophic injuries.... Read More

My wife got burned at a restaurant, what are our options?

Answered 10 years and 8 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
If the restaurant was more negligent than you were, you probably have a cause of action against the business and the careless employee. Consult a capable personal injury lawyer in your area.

Can we file for insurance if two trees fall on our house in a wind storm?

Answered 10 years and 8 months ago by Atty. Richard B. Jacobson (Unclaimed Profile)   |   1 Answer   |  Legal Topics: Personal Injury
The answer depends on your home insurance policy. Take it out and read it. You can also contact your claims agent and ask him or her whether your expenses are covered in your policies. Personal Injury Lawsuit Repeatedly Delayed: 5-6 Yrs

Answered 10 years and 8 months ago by attorney David B. Karp   |   1 Answer   |  Legal Topics: Personal Injury
Your case sounds unusual; years ago, it wasn't unusual that a lawsuit would take around 3 years; in the last 10-15 years, cases are handled much more efficiently and are usually resolved in the space of a year to 18 months. I am specifically referring to cases in Wisconsin. You place a lot of blame on the defense attorney for the continued delays, but what advice is your own lawyer providing to you on the reason your case is being dragged out or the delays caused by defense counsel? Most judges in my experience are very concerned about moving their calendars in an efficient, expeditions way and would not tolerate continued and inexcusable delays. I don't know anything about the substantive issues of your case such as how the accident happened, what your damages may be or why it is taking this long to resolve. Ordinarily, you are only deposed once, not twice or three times. Has the judge set mediation  to try to resolve your case? Have there been any offers on your case? I would suggest you have your case reviewed by another personal injury lawyer; lawyers are under an ethical duty to reasonably process their cases in an expeditious fashion without undue delays and to reasonably keep their clients informed of all the details of the case. Is your current lawyer doing those things for you? ... Read More
